I am up in front of the L/A committee for "parking" i was photographed by a traffic warden (no ticket).I was moving when he took the photo, though it was very slowly as i was intending to get onto the rank where a space would become free in a matter of seconds. The L/A officer is recomending i be suspended for 7 days ( in all there are about 12 of us up over 2 sittings)
where do i stand on this ? its all down to a photo as evidence against me.There has been alot of bickering with the wardens over a few months so surely his word against mine (and a photo) is not enough to "convict me" much help needed as i cant afford a 7 day lay off ,i have to pay £130 a week for my plate .

Ask why a ticket wasn't issued if you was parking illegally?

Ask for the warden to appear in person.

Ask for copies of the traffic order you are supposed to have breached.

Ask the LO under what section of what act a council is allowed to suspend a driver for seven days?

Ask how a parking ticket breaches the definition of a 'fit and proper' person?

Ask the councillors present if they consider a week with no pay as a proportionate punishment for a parking ticket?

Ask where in the council rules it states that the punishment for a parking ticket is seven days without pay?

Ask why the council is punishing your family by making them have a week without any money coming in?

And join a f***ing union so that these idiots LOs are brought to task. :sad:

I am being told that my hearing will be held behind closed doors . This is something i would object to ,can the council do this against my wishes. I think its being done this way to stop other drivers and press from being there.

Your hearing will be in part b, given this the press and public will not be permitted access, the reasons for this are set out in the various acts (I think it's the 1972 lga) normally due to financial or peronal matters which are not in the best interests of the public to know about.

You will probably get suspended but will be allowed to drive pending appeal to magistrates IMO

I would take the press man in as your advisor.

I would also advise the councillors present that there is an election coming soon, and do they want;

'TORIES PUT CAB DRIVERS OUT OF WORK DURING RECESSION'

No ticket was issued . i moved onto the rank before the warden had even spoken to me. he took my photo and passed it on to my L/A. Can i object to the closed door hearing and ask for it to be heard in open session.

If i appeal ,how much would it cost to take it to the magistrates court and is it worth the hassle ?

It depends.

Firstly people dont seem to get much in the way of costs back at magistrates.

The appeal to magistrates has increased in cost during the past year.

I cant see any decent magistrate allowing a 1 week ban or more for a mere parking offence, which was never proven.......although the council may say it has reasonable grounds on the basis of a complaint.

Facing facts here......can the councillors themselves honestly say they've never sat on a double yellow line waiting for a parking space? Lets hope they see sense and realise the licensing Officer is a f*ckwit.

In all honesty there are a few cases like yours going on around the country........we all know the source of the problem....too many cabs not enough rank spaces....

The guy will be going to the panel because a complaint has been made, not because of anything to do with a parking ticket......the fact he was parked albeit for a short time, is enough for some of these councils.

Around here some drivers have appealed to the court on various occasions and they use the 1847 act to claim for their costs as the charges were found to be unfounded.

The charging scheme they used was the waiting time on their tariff card. i.e. Number of hours spent on preparing for the case with any incidentals such as postage or the cost of lodging the appeal, any legal expenses etc. When the others realised how big the bill could get, they brought the item forward on the court list in order to save any further expense. As long as the figures can be explained with a tidy invoice and / or the tariff card, then there should not be any problem.

Were the costs against the local authority or the person making the complaint?

You can object to anything. Usually the private hearing is for your benefit, to ensure your details aren't put in the paper.

That said if it was me I would appeal, and appeal and appeal.
