Taxi dispute goes to appeal court

A cabbie with 37 years experience has taken Darlington Borough Council to court over its policy of making taxi drivers sit an advanced test. Malcolm Kaye was refused a Hackney carriage licence because he had not passed the DSA Driver pass certificate.

Currently the law only requires cabbies to have passed a standard driving test and have held a licence for 12 months. Mr Kaye, backed by his union Amicus, was challenging the council ruling that he should also take the advanced test.

In July magistrates in Bishop Auckland ruled the council had been unlawful. The council then took the case to London's Royal Court of Justice, and judgement has been deferred until Christmas.

Taxi drivers in Darlington are supporting his case, saying that drivers with many years of experience should be exempt from having to take the test. Gerry Huntley, Amicus regional officer said: "Malcolm has been a cabbie for 37 years, he's never had a complaint or been involved in an accident. "He's a victim of a mad cap test plucked out of thin air."

The council was not making any comment on the case.

they are thinking of doing the same thing on HGV licencing ie taking a re test every 5 years sooner or later the rules are gonna come from brussels and then there will be trouble

yep and a national wagon strike if it happens too

I think that is already in place, or will be very soon.

A mate of mine teaches HGV drivers for the new test, and he is a very happy bunny.

so yes conditions for taxis is a no no.

on driver licensing qualifications bye laws cannot be changed, read some decent law books insead of the button crap.

Well I did mean 'conditions' in the loose sense, ie as something that the driver has to adhere to, not the form that this something comes in.

But, anyway, the High Court clearly disagrees with you re the DSA case.

BTW, I don't have any of the books, but I'm maybe getting one for Xmas - what's the title of the Kearns book, I didn't know they did one
