The customer may think you are responsible if they are involved in an accident and the driver had their insurance invalidated.
You are the one that sent him to the address!
Customer buys double glazing from website topglass.com. Pays 3k to them. 6 days later subby turns up from another company and fits the glass, but makes a right mess of it. Customer complains to subby but he disappeared. Customer then goes to source, the manufacture, because they were the ones that sent the subby because they do not have any subbies of there own. I hope that story cracks it :lol: :lol: :lol: Running out of material now!

As for your second point I agree, but you are still liable for a duty of care to your customers to send a fully Licensed & legal driver.

I think he wished to have £24,000, then he could give out work to any PH driver who applied to him for work.

But isn't that what every PH office in the land does?

The problem is that he needs an ops licence that's issued by the same local authority that licences the car and driver.

Thus to provide a national referral service would require an ops licence for every LA in the country to then pass bookings to cars and drivers in each authority.

As well as the obvious cost and bureacracy barrier, the other obvious sticking point would be that LAs wouldn't issue a ops licence to take bookings unless this was done in their own authority area, I think.

Thus to provide a national booking service would require premises in each LA and an ops licence in each LA. Then bookings could be passed on to drivers licensed by that same LA. Simples :D

I believe his intention is to provide a service similar, but, on a smaller scale to that provided by the likes of Cabfind

There is no need for ops License because he is not operating any vehicles.

Your local travel agent does not need one when they book Mr & Mrs Smith a coach to take them to Blackpool. The Coach Company does though because they are the ones who are operating passenger vehicles. They are the ones who have to make sure their coaches are roadworthy and fully insured. They are the ones who are Liable .

The same could be said with a HC driver but on a smaller scale. The HC driver is the one who would be Liable .
The same could be said for PH companies who have subbies. A fully compliant PH Company always takes copies of drivers Licenses, MOT's, Tax discs, & insurance details. They will stop drivers from working if their insurance has expired for instance. They are the ones who are Liable .

The problem of default Liability becomes apparent when taxirouter gives a job to PH driver direct. The Liability becomes his by default because he next in the chain for prosecution/suing.

56 Operators of private hire vehicles..

(1)For the purposes of this Part of this Act every contract for the hire of a private hire vehicle licensed under this Part of this Act shall be deemed to be made with the operator who accepted the booking for that vehicle whether or not he himself provided the vehicle..

(2)Every person to whom a licence in force under section 55 of this Act has been granted by a district council shall keep a record in such form as the council may, by condition attached to the grant of the licence, prescribe and shall enter therein, before the commencement of each journey, such particulars of every booking of a private hire vehicle invited or accepted by him, whether by accepting the same from the hirer or by undertaking it at the request of another operator, as the district council may by condition prescribe and shall produce such record on request to any authorised officer of the council or to any constable for inspection..

(3)Every person to whom a licence in force under section 55 of this Act has been granted by a district council shall keep such records as the council may, by conditions attached to the grant of the licence, prescribe of the particulars of any private hire vehicle operated by him and shall produce the same on request to any authorised officer of the council or to any constable for inspection..

(4)A person to whom a licence in force under section 55 of this Act has been granted by a district council shall produce the licence on request to any authorised officer of the council or any constable for inspection..

(5)If any person without reasonable excuse contravenes the provisions of this section, he shall be guilty of an offence.

So suppose he's based in Birmingham, for example.

If he gets a Birmingham ops licence and passes work to Birminham plated PH vehicles and Birmingham badged PH drivers then he's OK??

Yes of course, but I still maintain he is not operating vehicles.

You are trying to pigeon hole taxirouter as an OPERATOR. He is not an operator of vehicles, merely a third party facilitator or go between. The same can be said of a travel agent.
