Harold Wilson never looked after the WM, but was led by the nose by the unions to give in, Bevan was the last true Labour man, since then they have been socialists-cum-communists and lately (from Blair) wannabee tories

Now you see this is where I have difficulty with time limited suspensions.

By suspending for one month the council is using suspension as a punishment. Does English law allow this?

I know that here in Scotland this is not permitted. Yes, the Act allows councils to suspend licences, but only as part of the consideration of a licence. TMK Edinburgh has substantially stopped temporary suspensions for punishment purposes.

The down side is that they revoke licences whereupon the licence holder has to reapply at the normal time, when he or she may be granted the licence again.

This happened in a case where the individual's licence was revoked. He was deemed not to be fit and proper following a spat which was never prosecuted. On reapplying his licence was granted.

So, the question is, what is the legality of temporary suspensions?

why dont the suspended pay a brief to take the council to court for loss of income/earnings and punitive damages then?

They've been told by the Council that they must pay the Council £500 before they can take it to court. The Council also told them that they couldn't drive on appeal. :roll:

That is correct Brummie, nothing has been written down.

I'm not surprised, but then the aggrieved drivers seem to be less aggrieved that some members on TDO about this matter.

And the apathy of the suspended drivers is food for the power hungry Licensing Officer.

The suspended drivers may as well become 'Rent Boys'.

At least that way they can be paid for being shafted!!!

This is some democracy we live in.

I suggest picking the poorest driver, with no assets and no cash in the bank, and seeking civil legal aid to defend his position.

Not sure if this would work, but certainly worth a try.

Another tack would be to seek the help of the local press. Letters to, depicting financial costs, ramifications of the council's actions etc.

Human interest. Draconian council. Could try attaching this action to another unpopular action by the council. There has to be a pattern. Councils don't just suddenly start acting unreasonably. It's in their blood.


Highlight other injustices.

On this vein all of the drivers could contact the press, radio and television and all of the MPs, Councillors etc and, along with their families - kids in tow - march en bloc to the unemployment office to sign on.

Unnecessary increases in unemployment at a time of economic recession with the increased burden on the taxpayer should just about get everyone's attention.

It's time to show the system guys just exactly how fecking stupid it is.

This is the reply I received following my email to Cllr Mays. Make of it what you will, but, having checked the initial information provided it does not actually say she is the chair of Licensing & Registration she is only a member of that committee. Cll Mays is in fact chair for Gambling Alcohol Licensing and Entertainments Committee.
