A TAXI driver caught puffing away in his taxi alone has become the first person in Southend to be prosecuted for smoking in a public place.

Paul Sutton, the chairman of Southend Licensed Taxi Drivers’ Association, was fined £150 for smoking in his cab.

A council health and safety worker spotted Sutton, 58, of XXXXXXX, Southend, as he drove along Queensway.

He admitted he had been smoking, although added he had no recollection of what he had done on that day. But the cabbie says he has now kicked the habit and taken to smoking an electronic cigarette in his car.

For him to get a £150 fine he must have summoned to court, and then gave the excuse of not remembering what he had done.

Clearly smoking must have fuddled his memory.

We've just had a "polite" reminder from the easy target revenue generation squad, it's £50 knocked down to £30 if you pay up, or £150 - £200 if you lose in court.

Someone mentioned to me it's totally unfair to expect a smoker to effectively quit to a deadline, maybe if they were to issue replacement stuff at the civic office licensing dept more drivers might be able to kick the habit, those electronic dummy fags would be a real help as they take care of the interaction side of things.

I'm a bit disappointed given the amount of opinionist here that no one has posted since me, I know I changed the subject a bit, but a bit of yeah your right or no your wrong wouldn't go amiss.

Afterall, we are the world opinion, the mavericks of opinion etc, don't let the side down.

Nobody is asking them to quit on a deadline or for that matter to quit at all.

Just don't be a d!ck and get caught smoking in your car, we have got them down here and I see it all the time, and when one gets caught it will be front page headlines.

If he now uses them electronic fags, he should have denide the charge where is the evedence, he could have had a pen in his gob for all we know, and he was on the move, i think the oficial has it in for him

Again I ask the question. Apart from taxi/ph drivers and bus drivers, have any other drivers been prosecuted for smoking in the workplace?

I sent a letter to the department in my LA on the subject.

Dear Ms *******

I write on behalf of members of Carlisle Taxi Association in reply to your letter dated 23rd August 2010, addressed to my secretary ***** ********.

I apologise for the delayed reply, it has been a couple of weeks since your letter was discussed at our association meeting.

The association obviously support any moves made by the City Council to stop litter being spread and the law being upheld in respect of smoking legislation.

You quite rightly make reference to recent fixed penalty notices issued to taxi drivers within the City.

With the above in mind, it is reasonable to suggest that an equal proportion of cab drivers smoke by comparison to workers in other occupations. We therefore wonder if you could advise how many van drivers, council workers and in general, other occupations, have been prosecuted by the council since the act came into force in 2006.

Obviously this information would be handy, as sure as night will eventually turn to day, we will be asked the question as people may want assured the taxi trade is not being picked on by council officers.

Dear Mr Casey

In answer to your query - there have been no prosecutions for infringements of the Smoke Free legislation - other than the one that I am sure you are aware of concerning Mr D********.

Written warnings have been issued to several companies & sole traders whose drivers have been seen by Council officers smoking in vehicles to which the legislation applies.

No ‘persistent offenders’ have been identified and therefore, in accordance with the Cumbrian Smoke Free Enforcement policy, there has been no need to take any further action.

If persistent offenders are witnessed then formal action will be taken in accordance with this policy.
