I'm not sure, in England a similar thing would be for a licensing officer to call a driver in respect of an interview pertaining to a complaint made.

The interview would be conducted under pace.

If a driver refuses to attend the interview the driver could possibly expect immediate suspension.......certainly in the case of certain licensing officers.

The next step in Englnad would be for the LO to interview the person who made the complaint.

Then the licensing officer would present a report to the licensing committee, who would then request the driver attend an interview.

If the driver refused the hearing it would happen anyway.

Based on the evidence the driver could be suspended, or have his license revoked.

I dont disagree with you.

I have been on the record and stated in conferences and in taxi magazines.....section 52 was a piece of anti driver legislation.

Indeed, I dont think it is right that a driver can be suspended by what may surmount to be a whispering campaign.

I think you've already guessed we're going down the ECHR, route. This Kangaroo court mentality has got to be stopped. It will be a long process but once the ball is rolling it should make interesting reading. Why should cabbies be treated as second class citizens?

I couldn't get a fair hearing in front of that council supposing my life depended on it. So I won't even try, it's straight into challenge the process.

Again I dont know much about Scots law.

In England you would be aggrieved and have the right to take the case to magistrates.

Unless section 52 has been invoked you can also carry on driving until it gets to court.

I don't have to prove my innocence Dougie, the burden of proof is theirs not mine.

Why the feck would I speak to someone that has already decided my guilt.

I play by the rules, just get on with what i do and Make sure i give no cause for concern

Genuinly i havn't an ounce of bad blood in me and you know it :shock:

When ever we come across each other i feel i portray the funny side of the game, you know just having a laugh about you and Jim's un winnable game (my opinion)

No one likes to see another lose their licence and i don't want you to lose yours but you play your game and i'll play mine, fairly and without discrimination

Again I dont know much about Scots law.

We have a process of appeal before a Sheriff, and so it goes on, Judicial Review, etc.

I'll have my appeal in before the ink is dry on their decision to suspend the licence.

I am wondering if it is a condition of his licence.. that when asked to attend their hackney establishment... for whatever reason... it becomes an offence if they don't.... and whether they will proceed with that....

Dougie, I actually like you as a person, and I don't detect an ounce of bad blood in you, but you do hold yourself up to be shot at. Some of the things you come out with are completely nuts.

Unfortunately, if you put your head above the parapet on a taxi forum you can expect to have is shot off.

He would not accept my right not to speak to frivolous, malicious, unfounded, unsubstantiated allegations. Who made Frank Smith, Judge, Jury and Executioner? I don't have to prove anything to him. The fact is, he was trying to force me into doing exactly that, which proves to me at least, that he's a cu*t.

If I had spoken to the complaint he would have put up in front of the council anyway. This way he has less than nothing.

I've spoken to him once before and his body language betrayed his intent. He wanted to fu*k me and Jim, big time :-|

I expect to be suspended because that's their right to get the battle under way, but it's who wins the war that counts. I am under no illusion how this is going down. :-|
