Death crash cabbie’s driving ban is halved



A CABBIE who killed a pensioner when he ploughed into the man’s broken-down car has had his driving ban halved by appeal judges.

Lino Borg, 41, of Sullivan Way, Langdon Hills, was jailed for 16 months and banned from driving for five years at Basildon Crown Court in September, after admitting causing the death of retired butcher John Cooper, 74.

Yesterday, his driving ban was cut to two-and-a-half years at the Court of Appeal, where Lord Justice Moore-Bick, giving judgement, said Borg had learnt his lesson and would want to return to his work when released from prison.

Mr Cooper, of Partridge Green, Pitsea, broke down on the Southend-bound A127 at West Horndon in the early hours of December 3 last year, and was sitting in his car, in the inside lane, when Borg ran into the back of his stationary Volvo.

The pensioner suffered multiple injuries and was pronounced dead at the scene.

Borg was arrested and charged with causing death by dangerous driving.

Investigations showed no evidence of Borg braking, leading to suggestions he may have fallen asleep at the wheel in the moments before the crash.

His lawyers argued the ban was too long, as it would mean he would be unable to get back to work for a long time after his release from prison. Lord Justice Moore-Bick said: “The appellant is a taxi driver and is likely to want to resume that occupation as soon as he can.

“The dangerous driving in this case bears all the hallmarks of falling asleep at the wheel for a brief period.

“In as far as the appellant had a tendency to push himself to the limits, we think he has learned his lesson.

“We don’t think it is in the public interest that he is kept off the road for such a long period of time after his release.”
