A disabled Dundee driver has been told by a QC for the unite union that Dundee city council do not want to go to court on the 18th Jan.The unite union want the council to give the driver a saloon licence because of his disability.The council have previously refused to grant the driver a variation of his licences to allow him to put on a saloon, he currently has a wav.

The council have asked the QC for the union to refer it back to them.I will keep you informed.

Could this be the first signs of the Equality bill helping disabled Taxi drivers ?

My personal view is not to trust the Council but it might just be that if they went to court and lost it would set a precedence

I concur with your view. A precedent that would not only affect Dundee, but all LA's. I wonder if they realised that and took a step back.

I hope the QC has not been hoodwinked by the council and they refuse on different grounds.
I know a lot of drivers in dundee will not be happy if he is granted a varaition but you never know whats round the corner.

Tone, it could be in all the drivers favor if it does go to court, remember its only the secretary of state that can stipulate the type of vehicle to be used
Just think of that new skoda superb :wink:
You should try and contact this driver and tell him to inform his QC not to back down and bring the above up in court

No its a different case this driver has a wav and was left with a really bad leg after being assaulted, he has asked for a variation of his licence to be able to put a saloon on


The court date was for the 18th Bruce Matthew v Dundee city Council

when he was assaulted someone jumped on his knee and because his other leg has been taking most of the wait he is needing a knee replacement.

What is the point of a WAV if the driver can't actually load a person in a wheelchair other than a measure by which to restrict access to a trade via financial means

The QC has said that it would be very hard for them not to give Bruce a variation to his licence especially with the equality bill.I still would not trust the Council thou.My fear is that when they hear his request they refuse him for some other reason rather than the one that was going to be heard in the court.

Maybe someone can let me know if that can be done :?: but surely a QC would not fall for that unless the best he was expecting in court was for it to be referred back to the council :?

previously Bruce had asked for a variation and the 6 months time limit had elapsed, they said that the 6 months rule did not apply to a variation :?

Without wishing to appear harsh, why cant he drive a WAV and have an exemption?

My thoughts as well CC.

Why should any individual be able to use a cheaper to buy, cheaper to run, vehicle. If he is given a "wheelchair exemption" via a medical, he should then be on a level playing field with all the other Hackney proprietors if he has a WAV.

It would also be possible for a "carer" to load any wheelchair jobs that came his way.
