The health and saftey at work act provides for risk assessments. In other words you dont have to push some fat b*stard up a ramp. Or carry some lazy tw*ts suitcase if you think it weighs too much.

Nevertheless, this one will be interesting.

Okay CC, then why the need for an exemption certificate issued by a council? When the Health and Safety at Work Act, (HSA) already provides the protection require to do your job?

Many wheelchair users come with helpers willing to load the wheelchair also many wheelchair jobs are kids or frail passengers, buying a wav taxi allows you to cover your options, turn up and if your unable to carry out the job don't do it, like Skull indicates you don't have to do it if you feel unsafe.

Not having a WAV though is a disadvantage, not wanting to load a wheelchair is a sign of a lazy taxi driver, unless holding an exemption

Thats a false argument, the wheelchair facility isnt used by a good number of passengers, but the back seats are. The use of the vehicle in my view is incidental.

Perhaps you should ask the people who drafted the DDA and the Equality act?

I do not think you would like to tell someone in a wheelchair that you cannot take them, its bad enough telling people you cannot take five .Also many Wheelchair users do not have cares what then.

Exemptions from the duties - Section 166 allows licensing authorities to exempt drivers from the duties to assist passengers in wheelchairs if they are satisfied that it is appropriate to do so on medical grounds or because the driver’s physical condition makes it impossible or unreasonably difficult for him or her to comply with the duties.
