Unless of course the guy has purposely went out and copied another companies top sign.......which does raise the question as to how TDO is being used.

Sorry to go against the grain as usual chaps (and chapesses), but I suspect it's nothing to do with the LO or LA.

It's more probably a competitor complaining about 'passing off', ie infringing a business name, trademark or something like that. Patents and copyright are more to do with designing things and publishing.

The biggest clue, I suspect, is at the top of the thread - if it was the LO or LA having a problem why would a solicitor be making contact?

More likely a competitor has complained to a solicitor, hence the letter.

So presumably the letter mentioned the name of the firm that made the complaint?

If it's the West End Cars in Southampton then because it's quite close by they probably have a point.

The fact that it's in another LA is irrelevant.

It's the fact it's a business name that's the problem, because you're both pitching for phone work. As far as customers are concerned the LA isn't really relevant. They just see the trading name, and yours is the same as an already established business.

Sorry to be bringing bad news, or if I'm barking up the wrong tree, but because of the closeness of the two businesses they probably have quite a strong case if the two names are identical.

If you were the other end of the country then things might be different, but clearly that's not the case.

So unless anyone else can proffer any better advice you should really see a solicitor if you want to fight it, but if you're just a few miles apart it might be a better idea to go for a different name.

at one time there was an AOP (registration of company names) thing but that was abolished, so theres no actual offence here, plus i doubt either party are Ltd companies, so it will come down to whoever has the biggest pockets (might is right) but in most cases its just not worth the hassle

first time round my LA sent a list of PH in this area, i decided on a name for the ops licence, the LO said fine, 2 weeks later he said "oh by the way, thats the name of the biggest taxi firm in the next town (same LA)....."

Id suggest that whoever had the name/design first or was trading first has the first claim on them, i also doubt a court would decide in the newbies favour, and that after a costly (for both sides) action
