Well what was the allegation? (in full)

Did it involve an allegation of a criminal offence as well as 'cab' related offences?

Sometimes 'civil' complaints disclose a possible criminal act, in which case licensing authorities up and down the country will no doubt have a policy in place under a partnership approach to involve other agencies.

What happened was an allegation was made, the allegation is unsubstantiated, their is no corroboration.

The council departed from its procedures in its haste to conduct this witch-hunt.

A number of breaches of human rights associated with their process have been drawn to their attention.

We await their decision. Either way, the way forward for Gerry is clear.

We have a preference for them to take a particular action. We must wait and see whether it comes to fruition. If it doesn't now, it will in the future.

Meanwhile, I have been advised that the council is out to get me. Imagine that. What could I possibly have done to deserve their attention :lol:

But what this does show is that the council appears to be working to an agenda. Just like their predetermination in Garry's case.

Question is, is this what council's should be doing? Is this what parliament intended when it crafted the CGSA?

And isn't abuse of power by the state the precise reason why the Convention of Human Rights came into being and why the UK was one of the first signatories?

Interesting time.

BTW It would appear from emails sent to us from council officials that it seems determined to deal with the matter under CGSA. It probably feels comfortable doing that. But this process hasn't even entered that yet. And it likely never will.

Spoke to a very respected councilor the other night at a lodge meeting and apparently you are going to make advances to a female passenger next week :D they are just waiting for her complaint :lol:

The sad thing is that if this did happen, you would see it as a kind of victory. The abuse of power wouldn't bother, you, because you think it doesn't involve you.

What part of **** Germany and the Holocaust didn't you understand.

Garry is right to say that this isn't about him. he was never going to kneel before od.

This is about YOU. Keir and the turkey need you to be subservient. They need to demonstrate their power to stop you lot getting out of control.

And by exercising their power in an unreasonable way, and taking draconian measures, they control you.

This is how it has always been.

Except the niggler in the woodpile is that Human Rights now comes into play.

The Act states "In particular, the Act makes it unlawful for any public body to act in a way which is incompatible with the Convention, unless the wording of an Act of Parliament means they have no other choice."

This may be what the council is relying on, they will claim they have to enforce the CGSA, it's the only Act they've got to work to, and the HRA gives them an out.

Except what they do within their process is not stipulated by the Act. It's their interpretation of it. And they don't have to do any of what they do. It's their choice.

And they have deliberately chosen to ignore any discussion about Human Rights.

Well if the HRA was irrelevant authorities would be winning their cases hands down. But they aren't.

The sad thing is that the scumbag Keir will be off into the sunset by then. Not responsible for the decision he made to breach Human Rights. Except through legal suit of course. But that's a groundbreaking matter for later.

Then there's the council solicitors, who are clearly out of control. They'll avoid any penalty because they'll close ranks, the council and its taxpayers will foot the large bill and once again the Executive, Sue Bruce, and the political machine will refuse and fail to hold them to account.

Then they'll do it all again and some other scrote will have his rights breached. It may be you saf :lol:

So really it's one down and the rest of you to go.

BTW Don't be shy, tell us all who this "respected" councillor is who feels justified in abusing the system and his position to dig me out?

Too shy, then please tell him to bring it on. I know full well that I will become embroiled in this process. Because I am embarrassing the council and the turkey for their short-comings.

However, it just makes the problem bigger. Much bigger.

And, one political dig out you can explain, two becomes more than a co-incidence. I can't wait for this case to come to the Court of Session, me bringing a second would be a hoot.

Oh, yes you do.

The only change is that the prosecution can now point out that anything used in your defence, you did not tell the police at the time of your arrest.

As Gary was not arrested for anything or read the following caution, this does not apply.

    "You do not have to say anything but it may harm your defence if you do not now mention something which you later rely on in court. Anything you do say may be given in evidence".
