it could be murder or flatulence

it doesn't matter the principle is the same

and thats the point

i should know i was suspended for a month for parking the taxi at the airport,in the prebooked area for taxis.
i refused to show a copper what was on my data head stated that it was protected by the data protection act(and it is)
he took great umbrage at this :D :D

because of that i was carted off in a meat wagon held inside it for 3 hours on a very hot summers day, and then suspended for a month despite doing nothing wrong and no charges ever being brought against me

If you know what a fit and proper person is then you know more than Edinburgh Council.

Apparently you can become unfit and then fit again a short while later.

This has to be an Uncle Tom logic that only someone like you can understand CC.:roll:

Ah, so you wwere suspended for a month because you were not a fit and proper person to hold a licence. Then after the month's suspension you were fit and proper again to hold a licence.

So, how does that work? Of course, this is clearly defined in the CGSA.

It is isn't it?

Sounds to me like a good support case for the Judicial Review.

Question is Ali, will you wear a suit in the witness box? :lol:

Their decision to revoke a licence would leave them open to challenge on how they came by that decision. However, if they suspend your licence you are disputing whether or not they have the power under the CGSA to do just that. Look at it this way Frank, because my licence is suspended Inspector Frank Smith gets to whack off in the toilet every time he interrogates someone like you. He confuses fear and loathing with your respect for his position. This why you make a point to tell everyone what a nice and reasonable chap the Cab Inspector is. He has a *ank and you breathe a sigh of relief for another day.

The council should be doing everything in their power to protect cabbies, first. This is your starting point. Now if there is a question over whether or not someone is a fit and proper person to drive a taxi. It should be decided by an independent body and not a bunch of power mad politicians. You would need clear criteria and definition of what it is to be a fit and proper, so that everyone knows what is expected of them and when they are crossing the line.
