The other side of this is that I am trying to compete with this other company for school contracts. It's not easy when an escort is required and he pays £3.00 an hour.

The escort should also be paid the correct min wage

We know that she should but she is on benefits and doesn't want to come off. I have brought this subject up at the county council forum because loads of escorts are paid similar. The council are not interested because it would increase the cost of the school transport if things changed.

That means the council and the company are breaking the law

The council have sugested that some escorts are volunteers and don't get paid at all.

an ESCORT (or indeed a non owner driver driver) cant comly with the basic self-employed criteria, i.e. they take no financial risk, cant dictate when they work, etc, so maybe you should send HMRC, and the DSS into the company rather than targetting the poor saps lured bya bit of cash, its the company thats creaming em

I am not sure that this is always the case. I have a driver who used to work for another company in the town. Since he has left they have reported him for claiming benefits and working. The fact that they knew he was claiming benefits and they still paid him cash in hand doesn't seem to be being investigated at all.

You will be competing, when the guy has been rumbled!!

Because he will not be staying with his present firm at their rates; he will be working for you at your rates.

They won't work for me because I insist that they are on the books.

Even if nothing is proved, usually the illegal workers quit when an investigation is underway
BTW, even voluntary work is supposed to be declared to the DSS and working voluntary for a non charity would look iffy.
