well now....

i had a bump, truck changes lanes as i passed him, he clips my rear N/S wheel arch

hes not accepting liability, neither am i

(he claims to have a witness, driver had a passenger, which im told cant be his witness then?)

i had a price of £1420 inc vat to repair

my excess is £550

but today a bodyshop quoted £350 (cash) to fix it (without cutting out the whole rear 1/4 panel)

will i lose my no claims discount (was 3 years last renewal) if i dont involve my insurers to pay for repair?

What about his damage?

Is he going to claim against you?

Will your insurance company settle, even 50/50?

If you are going to pay for your own damage, then use DVLA Form 888 to get the name and address of the registered owner of the truck.

Write directly claiming your repair costs.

Don't take NO for an answer!!

Go to the Civil Courts and get their 8 leaflets explaining each step for civil action and follow that guidance.

It is a no claims bonus, so as long as your insurers don't cough up anything you should be OK. However bear in mind that if they have recorded an incident, they may keep the file open for six months in case the TP tries to claim. Word of warning, if you reported the incident to your insurance co, chances are they will have recorded it on the Claims and Underwriting Exchange database.

If you change insurance cos or renew ANY motor insurance and you fail to disclose the incident, even if not claimed for in the end, you could be considered as being guilty of "non disclosure". Everyone has a "duty of disclosure" and they are interested in any incident!

This subject was actually covered by Watchdog this evening.

Glad you got it OK.

The Watchdog porgramme does emphasise the situation quite well. Sadly where most people come a cropper is that they assume insurance co's only want to be told of claims. Not so, they also want to know of incidents which might have been a claim. Stricly speaking, if you drive your motor into a wall but fix your car and the wall yourself, in theory you must disclose this because you have sufferred a loss.

I think we have had to cancel 2 taxi policies this week due to non disclosure. The bitter pill is that they were both for non disclosure of non fault claims. The clients in question did not have English as their native tongue and it makes little sense to them. They had used claims management companies to get settlement thus by passing their own insurers, however it still ends up on the CUE as their details are entered by the TP insurers.

Have a look at www.cueuk.org

Happy Days :-k

problem is the quote of £350 is for a cash (££££££) job, the bodyshops quiet for work, normally £550, so there wont be an invoice to produce if asked. (naughty i know...)

ive got all the details and the other parties insurance company details too

id pay then claim direct off the 3rd parties insurance, if no joy id pay £25 for a CCJ

as far as i can tell (ha) my insurance is all good, my details/dval are all correct, ive reported the incident to LV, who passed me to Highway, who issued a claim ref, and i emailed back the repairers quote (when i was intending to go via the insurance), they said no problem.

so its logged on the system/whatever

rounding an island in the 1 available lane which exits on the right lane of a dual carriageway, the left lane being ONLY left and occupied by the truck, who then swings across my rear...

no lights or indicators but his boss says he doesnt have to indicate rounding an island...

Well that's it. The final quote is in and the renewal is £1175 per vehicle. A rise of 30% on last year.

i wonder how many swallow the repair costs cos the combination of excess and loss of NCB (over 3 years) is too much, and how many wish they hadnt claimed?

ive cancelled my claim, and as of yet the 3rd party hasnt made a claim against me, my insurers have re-instated my NCB

repair has turned out quite well, our LO wont spot it at age-exemption time.....lol
