Not Criminal - Road Traffic.

Contravention of 1988 Road Traffic Act Section 40A, 1 (c) was the charge in Wallsall, Birmingham.

The current case in Plymouth - against the byelaw's if the press have it correctly. Prosecution is by LA not Police or CPS.

It appears we have another one as well, waiting in the wings - Police and LA are deciding whether or not to proceed, so I am led to believe.

I have been "vehicle checked" by a Licensing Officer - ramps, straps etcetera were looked at. They know I do a lot of wheelchairs. They also know I do it correctly. I think they wanted other drivers on the rank to see the check to encourage them to have all the kit. In my opinion that was a good thing for them to do. Without dropping anyone in the natural fertilizer, they make a point. (I got an advisory on a tyre though - at 2.1mm tread depth.)

Trouble is there is a groundswell of opinion that the easy way is simply to refuse wheelchairs - just say for whatever reason "will not - Health and Safety".

The upside of that is - more work for me. =D>

May. You may be abducted by aliens.

. . . And a passenger who chose not to wear a seatbelt?

Same 'may' charge?

Transporting goods in an unsafe manner.

Insecure Load?

Traffic Dept to the best my knowledge over the last 20 odd years have never stuck a cabbie on for insecure.

Lorries a plenty, but never heard of a cab.

And VOSA? They don't know where London is.

In reality, you could apply that to every vehicle in Britain that has shopping in it, the old can of beans under the brake scenario that used to be popular amoungst some Police Officers, or the old unsecured radio set in Minicabs that floats around under the drivers seat.

Once a wheelchair is in the back of my cab, to be honest theres not that much room for it to move around, if they don't want to face a certain way, and a horrendous accident occurs in London at 7mph, the most they'll do is land on the carpeted floor, or soft seats.

Its a risk, but then taking punters who never wear a seatbelt is probably as dangerous as they fly forward into the partition, chair users are already parked against it.
