his approach to the island is marked left/A5 west into 1 lane but the island itself isnt maked as such

I'll be surprised if the insurance company don't settle this on a non fault 50/50 basis. It doesn't make economic sense to fight it if the other side Denies liability. I hope they don't and good luck getting it sorted

If he crossed his right hand lane marking on the island, he should have signalled.

Take photos of where he was etc.

Signals and position.
When taking the first exit to the left, unless signs or markings indicate otherwise
signal left and approach in the left-hand lane
keep to the left on the roundabout and continue signalling left to leave

When taking an exit to the right or going full circle, unless signs or markings indicate otherwise
signal right and approach in the right-hand lane


keep to the right on the roundabout until you need to change lanes to exit the roundabout
signal left after you have passed the exit before the one you want
When taking any intermediate exit, unless signs or markings indicate otherwise
select the appropriate lane on approach to the roundabout
you should not normally need to signal on approach
stay in this lane until you need to alter course to exit the roundabout
signal left after you have passed the exit before the one you want

I intend to pay for repairs then claim direct off his insurers via his brokers

i may have an independent witness

well im not claiming off my insurance, may as well try off his (wont cost me) and coming out fighting instead of waiting for him to claim off me seems a good idea

It already is costing you. You are paying for the repair and hoping to get his insurers to pay up. Also when you renew your insurance you will have to disclose your "loss" and you may get a loading on your policy because of it. If you don't disclose it and you need to make a claim in the future you may find that your insurance is invalid because of the non disclosure.

GD, not sure where your coming from

im paying anyway, not making a claim off my insurance and informed insurer of the accident same day

id obviously disclose all facts on renewal and know only too well they will try anythng to up the premiums which makes attempting to recoup my bill for repair a no-brainer, it cant cost me any more than im already gona get hit for and i may possibly get £350 back even if i have to go to the small claims/county court

he who dares, wins rodney

PLUS the other party may think im running scared if i dont go for it and come after me with a claim

the way i see it it is that im already stung, so why not................

but my excess is £550 and the cash job is £350 (less to put out on the chance of winning)

the pukka repair (£1500) is 7 working days, the cheaper option is just 2

by the time ive paid for school cover, extra excess, and so on im losing money i dont have going down the insurance claim route
