As I understand it the Berwick case was about HC being licenced in one area but prodomintly working another area. Whilst the suggestion you have made (BC) may fix the Berwick problem I still believe it will prevent or at least cause confusion still for HC that are legally picking up in other areas. I believe a more simple solution would be to prevent HC drivers acting as PH drivers in any other area than the area in which their HC licence was issued.

The Berwick case was about out-of-town HCs working for a licensed PH operator on a 'foreign' radio circuit away from their own home LA.

The simple solution is to amend the legislation so that a licensed PH operator may only use HCs from the LA in which they are both licensed, thus preventing the abuse.

phones and internet cant be limited to LA border lines, and thats a fact, so thats what we, and LA's, and public have to live with, plus it gives customers complete freedom of supplier, under EU laws thats a legal right

No, that is not what you said, it may be what you meant to say but it is not what you said. You said to stop HC drivers acting as private hire in other areas. Where as Brummie has said that private hire operators can only use hacks from their own area.

Either way the HC driver will only be able to work PH in their own area or more to the point from an office in their licenced area. PH operators are already only supposed to use vehicles and drivers that are licensed by the same authority as themselves, therefore my thinking was to prevent the HC from working in an area they are not licensed for. Either way works for me :D

Yes, but be careful where you sit cos you could get done for illegally plying.
