Yes I appealed the moment I got it, I tried phoning them but all I got was a recorded message asking me how I'd like to pay.

Hi everyone, newbie here so please be gentle !!!!!
I was given a ticket on a rank once while I was having a jimmy riddle in a cafe. when I came out I was greeted by an enforcement officer and a traffic warden who was just attaching a ticket to my cab. I argued my case but they were having none of it. I lodged an initial appeal that was rejected, I then made a formal representation after logging onto the Traffic Penalty Tribunal website (If I was clever enough I would post a link here, but I'm not !) and under the example cases (taxis and private hire section) saw a very similar case that was heard and the driver won. I quoted this case and very soon had the fine dropped by the council.

Happy to hear you got the ticket overturned, but there may be two seperate issues in your case, parking and leaving the vehicle. As it stands it is an offence to leave a cab unattended on a rank - but that's not what you got the ticket for. It just may be that you were ticketed for parking illegally, but the appeal decided that as it was a hackney and on a rank (even though unattended) it was not parked illegally.

I received a parking ticket a couple of months back, in of all places Birkenhead magistrates' court, I appealed, they sent me back a photograph clearly showing that my ticket could not be seen. due to the fact that my window was edged with the smoky black edging .... so therefore the details on the ticket could not be seen... I sent them back a photograph taken from a higher height.... which clearly showed the ticket..... I also advise them to employ normal size people rather than dwarfs.... as this would stop any confusion in the future..... ticket cancelled.

Hi Sasha,
My ticket was issued for leaving my cab unattended on a rank. The council's logic was that by leaving my cab unattended it ceased to be availiable for hire and was therefore illegally parked !
After quoting the example case below to them (took from the traffic penalty tribunal website) They cancelled the ticket.


When is a taxi available for hire? (SQ05010H)
Driver of a licensed hackney carriage, the appellant left his vehicle for a few moments on a double yellow line while he went to the toilet and was issued with a PCN for waiting in a restricted area. The council contended that he was not entitled to wait in the taxi rank, because the vehicle was unattended, not available for hire and therefore not "a hackney carriage" as defined in the bylaw. The Adjudicator, ruling that he did not interpret that to mean that the vehicle ceased to be a hackney carriage for every minute that it was not in such use, found that the common sense view of the appellant's vehicle would say that it was a vehicle used in standing or plying for hire and had the required number plate fixed on it. He was also satisfied on the facts that the vehicle was available for hire, except that any passenger would have had to wait to depart until the appellant returned from the toilet.
The appeal was allowed. [/color]

I didn't get anywhere with my appeal, I got the leter back Friday telling me I'd lost the appeal.

Why did you contact them in the first place, you should have just binned it and totally ignored any correspondence from them
You where told at the time, the ticket is only a receipt
