I just had a peep over there, it would seem a lively debate is taking place.

I personally can't see Edinburgh lifting numbers.

It's an interesting situation.

I tried to ring the council the other day offering my legal services to help them out.

Having read more into the Edinburgh situation It would appear according to the discussion on Fastblacks that the six month grace the council have in deciding whether or not to grant a license is up in a Months time. It would also appear according to one poster that the Survey commissioned by Jacobs will not be completed before August. It would appear the only slim chance Edinburgh council had of refusing these licenses has slipped away from them. The slim chance I'm talking about and it would be a very slim chance indeed would be a provisional report by Jacobs saying they have so far found no evidence of demand in any of the areas so far surveyed. Like I said that is a very slim chance and it is debatable if a court would entertain that.

So those people who have been brave enough to challenge the legal right of the council to withold a license are presently in the driving seat.

What they must do now in the likelyhood that Edinburgh council refuses their application is "immediately" instigate court proceedings. Any licenses that the survey throws up will have to be granted to these applicants before anyone else.

Previous reports tell us that Jacobs may well say there is no unmet demand at all but these applicants shouldn't worry about that because at the time they applied for the license the council was not in a position to refuse them.

Interesting developements in Edinburgh. I wonder which licensing Authority will be next in Scotland?
