post both sides of the PCN, let us look at what on there

the point for your appeal would be there should be an exemption for picking up and droping of, you would only get information from the TRO, it may be like a lot of PCN it could not comply to the regs only find out if you know what to look for so post it. or fax me a copy and i will look at it. even if you have paid it lets look it may be we could get your money back.

Take it to the adjudication - though you would have to travel back down to London for the hearing (it's held in Angel, N1), and the adjudicator will take into account how old the passengers were, if they were disabled and how much luggage they have.

Under Regulation 12 of The Road Traffic (Parking Adjudicators) (London) Regulations 1993, you are able to claim costs if the council acted frivolously, vexaciously or wholly unreasonably. In this case, the council has been acting wholly unreasonably since you had an 83 year old passenger with their luggage. You'll have to prove it though.

no problem there, as i mentioned earlier.
i actually spoke to him and introduced my passenger to him and he actually said he would make a note of it in his report, (Mmmmm will he really)

ok ive checked out wandsworth borough council and apparently i can do (first part) of my appeal online,
and looking around the forums, i will most likely be told to "naff off" we want ya money. :twisted:

is there anybody out there good with stringing words together, (iam useless) or anybody been throu this before that can give me some good pointers. #-o

Sometimes, up to the day before the adjudication is due, they may send you a letter saying they've cancelled the ticket due to a "technical error", i.e. they've deleted/lost the photos (evidence) they took of your cab when your ticket was issued.

I would hang in on there, and take it to the adjudication and hope that may happen.

If it doesn't, and you're unable to attend the hearing, the adjudicator will look at your evidence, and the council's evidence, and you'll be informed of the outcome by post. However, if you are able to attend in person, then you're chances of winning are probably higher. A representative from the council don't usually attend, as it's not worth their while.

One of my drivers had same kind of thing we badgered the council and in the end they didnt want the bad publicity over the hoo-hah of picking up an elderly lady in her 80s so it got cancelled.

Sorry, a bit late to this one.

There is a laid down procedure in TMA 2004. It is generally possible to find loopholes but you will need the expert advice available at www.pepipoo.com

They know everything there is to know from experience of usage.

Ask the department in question what their policy is regarding the loading and unloading of disabled passengers.... and also ask their local hackney licensing department the same question.... and see if they add up
