Welcome to Tory Wandsworth you should have brought a ticket from the machine saved plenty of agg dope!!

Anyway were you a member of a proper Union they would kill this off pronto but you ar'nt are you? tough sunshine you get all this agg for the sake of 50p clever :D

Parking bays for residents are there to protect the residents from the activities of free loading parking, on the estate i live on commuters parked in such a way that fire Appliances couldnt attend a fire end result 2 children BURNT alive! :twisted:

OK ive put this together,

PCN Notice..... WAXXXXXXXXX
Date..... 03/07/2012
Registration..... XX XX XXX
Was Seen..... Malbrook Road SW15 OS1
From 11.15 To 11.20
CEO..... XXXX
Contravention..... (12)
Parked in a residents' or shared use parking place without clearly displaying either a permit or voucher or pay and display ticket issued for that place

Dear sir/madam,
The contravention (wrongdoing) did not occur.

it was obvious at all times that the above vehicle was infact a licenced hackney carriage with the Newark And Sherwood District Council (Plate No 58) Expiry date 28/02/2013
it was obvious at all times that i was picking up a passenger from Malbrook Road SW15 OS1 (Number 1 to be accurate)

This was also witnessed by the CEO himself.
As i came out of the premises with the passengers luggage the CEO was still at the scene and still in the process of issuing the PCN. Whilst having a breif chat with the CEO i also intriduced him to my passenger to eleviate any further suspicion.

The CEO then told me that i could appeal the Notice and that he would make a note of it in his report.

when making your decision i would appreciate you take into consideration.

What is the necessary time for a taxi driver or minicab driver to pick up a passenger when they receive a pre-booked cab fare.
The time period starts when the vehicle arrives, the driver engages the passenger and the passenger comes from their premises, and enters the vehicle.
common sense and logic clearly tells you that this is all part of a process.The waiting for and the picking up of a assenger.
The general rule of law has also confirmed that taxi drivers, minicab drivers are allowed to wait for a long as necessary for the purpose of picking up a passenger and/or their luggage.

And finally another fact of the matter is the passenger.
AXXXXXX BXXXXXX,

Age.... 83

Blue Badge Number..... XXXXXXXXXX

Expiry Date..... 07/03/2013

The passenger could of been well fit and 38 years old, the fact still remains that as a taxi driver i am still allowed to wait for a long as necessary for the purpose of picking up a pre-booked passenger and/or their luggage.

The fact that my passenger is 83 years old and disabled with waliking difficulties, only means that it will of course take longer, and NOT 5 minutes.

Give the passengers age and infirmity a little more prominence. For fine adjustment, I will reiterate my suugestion to start a thread on www.pepipoo.com who know all about these things and probably have experience with that particular local authority. They don't bite and it would be better to get their input and get it right than get it wrong and still have to pay the ticket. Good luck.

Morally your right but of course that dont matter in the UK these days does it, if this council have their way your passenger will never be able to be picked up without him having to pay a surcharge your parking fee, they call it "Care for the elderly"

Hope you win it keep us informed.

I would have bought a ticket for 50p lot less agg!

true, but some of us "UK" people don't mind fighting for a right.

50 pence or 50 quid (not bothered),

You might want to fix the typo's as well. Some anal people will judge you on the quality of the writing.
It shouldn't matter but it might. No telling what sort of person the adjudicator is.

displayed, with reasons why they are invalid for that place.

Exemptions:
ADEH1IJKLNOP

Notes:
If a previously valid permit has expired then code 19 should

I had a similar case in Folkestone a few years ago. I challenged the ticket through the Parking Appeals Advisory Services as it was then and WON.

Quote the case of Gould v Shepway District Council to them. you can find the case on the PATAS site and on www.pepipoo.co.uk as Cabbyman has pointed out.
