 Post subject: Have I Gone Illegal?

I may have made a mistake on Saturday last. No comeback but don't want to risk falling foul in future. I think I am OK but would appreciate a view.

I was driving a PH and of course the taxi co has an op's license. As it happens, the firm insists all owners on the circuit also have their own op's license. I had a job over the datahead to pick up a fare from a pub and take to another about a mile away. Another pub customer asked me could I come back and get him afterwards as he wanted to go elsewhere too. My immdiate thought was that's fine cos I have the owner's op's license and the job was pre booked, direct with me in the same LA and I made a record of it for the owner's log.

It wasn't until later I wondered if I had transgressed.

Cant see owt wrong there..It was prebooked and you can pick up a pre book from anywhere in the UK if booked through your LA area and you were in your own area when the booking was made..

The OWNER of the car has an ops licence, the base should have had the details (the car owners base) is 2jobs the owner or the jockey?

He doesn't actually say that he has an ops license. He states that the owner has an ops license.

If the car's owner has the ops licence for the car, I see nothing wrong with taking a booking. Better if the booking was phoned to the driver, then there's a record of it.

In my view it' s slightly different to a p/h owner driver taking an immediate fare off the street which is illegal. I wouldn't classify what happened there as touting. He happened to be picking up a pre-booking and the punter's mate asked if he could do another job later.

Well as it was the driver who took the booking in the vehicle and the driver does not have an operators license and the vehicle will not be the operating office, I think it is illegal.

you may not, a court probably would though, the driver wasnt the ops licence holder

Yes, I assumed that one of our school runs started yesterday. I was wrong and it sure made an ass out of me, but I think that U got away with it.

See your point, but what if: Lets say I was an independent PH operator, only one vehicle with my own ops license but had an unmanned office with call forwarding as I think many do. If I had said to the second punter I can't take your booking face to face, but you can ring my office number and your call will be forwarded to my mobile and I can then take your booking, would that work? I guess he could email the office with the booking and that in turn will come to my smart phone which picks up my emails.
