I am a self employed Taxi driver working for the same company for 3 yrs , and I pay £240 per week rent to the company . The rent is a combined charge for car hire / insurance and work provided by our dispatch office . I pay for my own fuel. Work coming into the office is on a steady decline , and I am forced to work many many hours , just to cover the weekly Taxi rent and fuel costs, before I can make a penny for myself . To make matters worse I believe that I am being fleeced by the Taxi company owner . He feeds his percentage drivers all the decent council contract work and takes his 60 % ( some drivers being given up to 3 times more contract work per week than rental drivers ) thus linning his pocket .His wife constantly interferers with the day to day running of the taxi office , and after a small run in with her , when she made a poor decision , I have been subjected to childish discrimination, by having jobs that were originally given to me by the controller taken from me and given to a percentage driver . I have no written contract, only verbal . I heard that it is illeagal for him to feed his percentage drivers in favor of rental drivers , but I am struggling to find any usefull information that may help with this issue . Any advise will be welcome!!!!!

That's what you get in this trade mate, If a company has got drivers on a 60/40 split bag they'll get the lions share of the work. Ask the owner to put you on 60/40 split you won't be any worse off in fact you'll be better off by a few quid a week, you won't have the massive fuel bill, and you won't have to fork out £240 a week for the rental of the car.

Thanks for your reply , but not quite what im looking to do . Im thinking more along the lines of a tribunal, and would like advice on my legal rights . Work for this company has become impossible , so I'm looking for an exit stratagy as this is my only income .

Don't waste your time. You are self employed so you can't take the owner to a tribunal. However if you could prove that you should actually be an employee by way of satisfying the guidelines for being an employee then you may be able to make some kind of case.
Some of these things are, who says when you work? can you work for other people?, Can you pass on your work to others? There are other questions that need to be satisfied in building a case that you should be an employee and the best place to look is the governments web site.

Some firms are honest, it appears the one you work with isn't.

You have two choices, stay with that firm and accept the dishonesty, or leave and go and work with another firm.

Not saying either is an easy choice, but whatever the good folks on TDO say, those are your only options. :-s

Employed or self-employed?

In order to answer this question it is necessary to determine whether the person works under a contract of service (employees) or under a contract for services (self-employed, independent contractor). For tax and NICs purposes, there is no statutory definition of a contract of service or of a contract for services. What the parties call their relationship, or what they consider it to be, is not conclusive. It is the reality of the relationship that matters.

In order to determine the nature of a contract, it is necessary to apply common law principles. The courts have, over the years, laid down some factors and tests that are relevant, which is included in the overview below.

As a general guide as to whether a worker is an employee or self-employed; if the answer is 'Yes' to all of the following questions, then the worker is probably an employee:

Do they have to do the work themselves?
Can someone tell them at any time what to do, where to carry out the work or when and how to do it?
Can they work a set amount of hours?
Can someone move them from task to task?
Are they paid by the hour, week, or month?
Can they get overtime pay or bonus payment?

If the answer is 'Yes' to all of the following questions, it will usually mean that the worker is self-employed:

Can they hire someone to do the work or engage helpers at their own expense?
Do they risk their own money?
Do they provide the main items of equipment they need to do their job, not just the small tools that many employees provide for themselves?
Do they agree to do a job for a fixed price regardless of how long the job may take?
Can they decide what work to do, how and when to do the work and where to provide the services?
Do they regularly work for a number of different people?
Do they have to correct unsatisfactory work in their own time and at their own expense?

You are using an angency to supply you with work, he has no need to treat you fairly or legal obligation to do so.

wannabe's questions are relevant if your required to work stipulated shifts wear uniform Ties etc it could be Bogus self employment therefore you could be a "worker under the direction of the company" which is a half way house to PAYE and gives you certain emplotment rights.

but of course were you a member of a Union all this would be dealt with for you so go and join one! get the majority of Drivers into membership and the pricks who runs this scam has got a real problem at the moment hes got his hand in your pocket taking what he wants when he wants, not unusual in this industry !!!

already the majority on here are indicating youve little chance of being treated fairly and maybe you should find another Agency [for that is all cab companies are] well thats the serville grovelling way so prelevant within the industry and why it goes on unabatted!!
