Tell those c***s at the council they can't use CCTV to suspend, the RIPA rules have changed.

Councils can only use RIPA rules if the offence has a penalty of six months in prison or more.

Dear Mr. Neale

Does the driver of a Hackney Carriage on its own or in combination with other Hackney Carriages commit a specific licensing offence of 'over ranking' by the MERE FACT that the vehicle is parked or waiting on the street?

Yours sincerely

I really want to post an email sent from our LO, but they didnt send it to me for some reason :shock: it told us all about how ranking on double yellow lines wasnt illegal :roll:

It had nothing to do with the fact we have 20 rank spaces and 220 cabs, and we are an old city with limited parking, and the fact that they cannot issue additional rank spaces in decent areas because they dont control the roads. :roll:

Our senior compliance officer won't answer the question, despite being asked to 4 times.

:? :? :?

There is no Section 61 (2b)

Do they mean Section 61 (2)(b) or Section 61 (2B)?

Section 61 [Extract of relevant sections];

(2) (a) Where a district council suspend, revoke or refuse to renew any licence under this section they shall give to the driver notice of the grounds on which the licence has been suspended or revoked or on which they have refused to renew such licence within fourteen days of such suspension, revocation or refusal and the driver shall on demand return to the district council the driver's badge issued to him in accordance with section 54 of this Act.

(b) If any person without reasonable excuse contravenes the provisions of this section he shall be guilty of an offence and liable on summary conviction to a fine not exceeding [level 1 on the standard scale].

(2A) Subject to subsection (2B) of this section, a suspension or revocation of the licence of a driver under this section takes effect at the end of the period of 21 days beginning with the day on which notice is given to the driver under subsection (2)(a) of this section.

(2B) If it appears that the interests of public safety require the suspension or revocation of the licence to have immediate effect, and the notice given to the driver under subsection (2) (a) of this section includes a statement that that is so and an explanation why, the suspension or revocation takes effect when the notice is given to the driver.

Honestly, how do you lot put up with this shecht? If you only could get together to pay for proper legal representation, you could stop council ars*holes dead in their tracks. A few quid a week, 24/7 legal representation, and it's game over. Your average council wouldn't look your way without consulting with you first.

It's not even about winning. All you need is the ability to fight back with an inexhaustible War chest, and they would think twice about taking you on. :-|

You could own the streets and your council. #-o #-o
