They do already, its just they don't follow the obvious rules - as laid out by Michael Moore in "Stupid White Men ...and Other Sorry Excuses for the State of the Nation!".

Only if the driver is plying for hire, which would take further investigation to uncover OR are they going to argue that a driver in a marked vehicle waiting in the street is plying for hire. Oh please Mr Neale do go to the High Court with this one :D

Ashfield drivers commit no licensing offence by waiting in the street unless they are plying for hire,
The drivers could be stopped for any number of reasons, to go to the toilet, to get a cup of coffee, to have a chat.
Any of the above are parking contraventions only.
The drivers may well have pre-booked fares to collect, even a large block booking. (that is why their For Hire signs are not lit)
A driver may wait a reasonable time (anywhere it is legal to pick up or set down inc. double yellows etc.) for a pre-booked fare to turn up (Makda v The Parking Adjudicator)
Does the licensing officer know that they do not have a pre-booked fare ?
A hackney carriage driver has no requirement to keep a record of pre-booked fares, nor does a pre-booked fare have to come through a radio system, although a text message is always good back up evidence,
A pre-booked fare that does not turn up is still a pre-booked fare. (Makda v The Parking Adjudicator)
A pre-booked fare may well text or phone the driver to say "I will be another 5 minutes" (use your imagination)
Just because the driver ends up on the taxi rank does not mean he was plying for hire at the time of the alleged contravention, his pre-booked fare did not turn up so he joined the rank.

As to the high court, if the council argue and win that the mere fact that a driver with a marked vehicle waiting in the street is plying for hire, where do private hire go then?

You are right, but it’s even simpler for people working in an industry they depend on for their living. Without forming a consensus of what represents their interests. How do you go about defending your rights or income? You are left wide open to political vagaries with little or no way to change the law or the landscape in your favour. Your purpose is simply that of a political football, to be kicked around, when times are tough. If you have the legal capacity to go after your council, it doesn’t even matter if you win or not. It’s about tying them up in expensive litigation, until you can negotiate a solution which protects your interests.

Councils only do what they do because people allow it. :-|

Yes, but by the time a decision is made the law might well have changed.

So I wouldn't bother, in short you can make their lives a misery for nothing.

1000s of FoI questions will keep them busy. :-$

The Council have been on the phone this afternoon and because they are doing "OVERT" operations through the CCTV it doesn't come under the new RIPA act.

So is the CCTV fixed onto one location?

If not how will people know it's looking at them all the time?

If it swivels it ain't covert.

And ask for the minutes of the council meeting that approved this so-called overt action.

And maybe Mr Trotsky can ask his Labour friends why they are trying to f*** working cab drivers. :sad:
