The reason I was asking that question jasbar is that I have a prior experience in a similar situation and from all that I've read you've got a greater chance of redress going down the civil route. Obviously I don't know all the gory details and the politics of policing have probably swung in your favour but you'd be mad to place too much faith in the PF in my opinion.
Criminal proceedings as a prelude to civil.
And the PF is hamstrung.
Because McAlpine has set a precedent for pursuit. And we have a system here in Scotland which has stated a zero tolerance policy. How can you have a zero tolerance if you allow the ctime in the first place. And what was published on Fasties is irrefutable.
That the cops are even investigating proves that on the face of the crime has been committed.
It would be up to the defendant to prove his allegations were correct. And of course he couldn't. he has no evidence.
And his use of the term Lesbian in a derogatory manner is also irrefutable. How can anyone hold a public license, dealing with the public, especially in such a close setting as a taxi, when he holds such discriminatory views which tell of hatred for minorities?
Failure to act by the authorities would leave them open to serious charges.
