So the couple were bright enough to realise the difference between a taxi and a minicab but not bright enough to know they shouldn't have got into a minicab they hadn't booked

I always thought that touts were the ones that would arrange the illegal fares not the ones driving the vehicles

It wasn't a minicab. They only thought it was a minicab. We don't know if they had actually booked a minicab. I wouldn't say that they were not very bright. I would say that they were downright stupid.

I'm not even sure that's the case.

To me they thought the vehicle was one that was immediately available to hire off the street i.e. a taxi.

For any vehicle to be an unlicensed minicab the couple would have had to ring a number for it.
