This is bloody painful reading and Roy has my sympathy but as usual in my opinion your ALL barking up the wrong tree, clearly the council can change the regs to no age limit if you win the argument OR have the organisation to confront them politically ie a UNION fekk the law take em on Politically :evil: :evil: #-o #-o

Melton think the average yearly mileage for a taxi is 12,000 miles a year? So as an estimate that's 6000 paid miles @ £1.40 = £8400 per year gross.

LICENSING SUB COMMITTEE 13 FEBRUARY 2012
REPORT OF HEAD OF REGULATORY SERVICES
APPLICATION BY MR ROBERT CROFT FOR A RENEWAL OF A HACKNEY CARRIAGE LICENCE
1.0 PURPOSE OF REPORT
1.1 To inform the Committee of the reasons for recommending a decision to refuse the application from Mr Croft for a Hackney Carriage renewal on the grounds that the vehicle is older than allowed by the Policy to be renewed.
2.0 RECOMMENDATIONS
2.1 That the application for a renewal of this Hackney Carriage vehicle licence be refused.
3.0 KEY ISSUES
3.1 Mr Croft made an application for a renewal of a Hackney Carriage vehicle licence on 25 January 2012. Appendix A.
3.2 This application is for a Black Euro Cab, Registration Number AJ51 XZY first registered 14 December 2001, which means that this vehicle is over 10 years old. Registration Document. Appendix B.
3.3 Satisfactory insurance and M.O.T. documents were provided - Appendix C.
3.4 This vehicle was inspected in line with the application procedure and there were issues raised in the course of that inspection. These matters have now been rectified. Vehicle Inspection report– Appendix D
3.5 The vehicle inspection is to ensure that the vehicle meets the standards set by Melton Borough Council. However these standards should be met at all times and not just when the vehicle is sent for inspection. The fact that this vehicle had several matters which were not, when inspected, of the appropriate standard indicates that the age and extensive use of this vehicle may be affecting the ability to meet those standards at all times.
3.6 Melton Borough Council Policy states that any vehicle over 8 years old must have two inspections per year. This vehicle had its previous inspection on 31.8.2011. This is attached at Appendix E
3.7 There are particular concerns the mileage of 248,564 which is double the average mileage for a car of this age. ( Average mileage being taken as 12,000 per year)
3.8 Melton Borough Council’s policy states as follows:
‘Other than in exceptional circumstances and save for purpose built vehicles and conversions
approved by the Public Carriage Office:
a. All vehicles on first registration must be less than 6 years old on the date of the application for the Licence.
b. Vehicles over 8 years old but less than 10 years old on the date of application can continue to be licensed provided the vehicle passes two tests per year (the test to be six months apart).
c. No vehicle over the age of 10 years at the date of application will be licensed.
d. The age of vehicles will be judged by, so far as can be ascertained, the date of manufacture or first DVLA registration of the vehicle.

There is a drivers meeting with the council on Wednesday morning. I may have to mention these probable breaches of the data protection act.

That is the company phone number. I have spoken to the office manager and he is not best pleased. He has spoken to Michelle. I will have to have a good look around the council website because we also had a vehicle go before the committee just over a year ago.
