:lol: :lol: Sadly I was a skilled motor mechanic, I have been saying ever since that one day I would get a proper job!
Anyway carry on the good work, I just love the Scottish forum, life would be soooo boring without you and Jasbar winding them all up!

At least when skiman gets out he wont sell his country down the river to western money leaving the free Africans worse off than when they were under apartied - or will he? :wink:

Perhaps it becomes a bit clearer.

Found this following Philpott being sentenced to Life (15 years tariff) and his wife 17 years.

In England and Wales manslaughter has a "discretionary" life sentence, as opposed to the mandatory one for murder. This means the judge's discretion is used. He could impose any sentence at all, from an unconditional discharge, which means a conviction is recorded but no punishment given, right up to life imprisonment, or even a fine. Fines for manslaughter are normal where the defendant is a company rather than an individual (although it is usually easier to prosecute in such cases as a health and safety breach, as the punishment is the same and the conviction easier to obtain). An individual can expect a sentence of a few years.

The point of manslaughter compared to murder is that murder is an intentional act with an element of forward planning. Manslaughter is not and can be simply an act of negligence.


Philpott has a life licence. He will only be released when the parole board deems he is no longer a danger. And then he is on licence for the rest of his life and can be recalled to prison for any transgrression.

His wife's 17 years, she cab serve half and be released after that. She would then be on licence for the rest of the term of her original sentence.

I came across this story, which seems more relevant to the local case in question.

The country’s top judge has ordered a tough crackdown on drunken street thugs.

Lord Chief Justice Lord Judge declared that there should be long jail sentences for those who launch violent attacks – even if they do not mean to kill.

He said cases of ‘one-punch manslaughter’ were being treated too leniently. Greater weight should be given to the outcome of the attack than to the intention and ‘crimes which result in death should be treated more seriously.’

The Lord Chief Justice condemned the drink-fuelled violence which has spread since Labour introduced 24-hour drinking, alcohol became cheaper and courts adopted lenient sentences for drunks who kill.

He said ‘gratuitous unprovoked violence’ and ‘drunken yobbery’ had left ordinary people fearful of going out at night.

Lord Judge spoke out as the Appeal Court heard three cases in which vicious assailants launched drunken attacks which led to the deaths of innocent people. In two cases the victims died after falling and fracturing their skulls.

The Lord Chief Justice said the decision to sentence street killers according to the harm they do was in line with recent legislation and sentencing guidelines for drivers who kill.

Laws now mean that a careless driver who would normally be fined in a magistrates’ court can get five years in jail if their bad driving kills someone.

Lord Judge said the current approach to street attacks dated from ‘a time when there was less public disquiet about violent behaviour and death in town and city centres and residential streets than there is now.’

Two of the cases before Lord Judge and four colleagues were appeals by the Attorney General, Baroness Scotland, against lenient sentences.

One involved Thomas Bryan, 46, who had an argument in a nightclub in Rhyl, North Wales, with father-of-two Jonathan Bennett, then returned with a friend, Peter Roberts. CCTV showed the two men sneaking up on Mr Bennett from behind and Bryan striking two powerful blows.

Mr Bennett was unconscious before he hit the ground and fractured his skull. The trial judge gave Bryan credit for pleading guilty and sentenced him to three years for manslaughter. Roberts, 37, was given 18 months for the same offence because he struck no blows.

But Lord Judge said Bryan should get no time off for pleading guilty because the case against him was overwhelming and Roberts had helped in the attack. He increased Bryan’s sentence to five years and Roberts’s to three and a half years.

Roberts, who has already been released from jail, was ordered to report to police to be taken back. Lord Judge also overruled the trial judge in the case of Declan Appleby, given a minimum six-year sentence for the murder of engineer Ron Sharples. His life sentence term was increased to a minimum of nine years.

The court upheld sentences of seven years and seven and a half years imposed for manslaughter on Ben and Tom Cowles, who attacked senior Barclays bank manager Frank McGarahan near a taxi rank in Norwich. The two men had appealed against their ‘excessive’ punishments.

Lady Scotland said after the ruling: ‘We welcome the court’s conclusion that cases which have often been referred to as “onepunch manslaughter” are often nothing of the sort.

‘If there is anyone who does not know that if you punch someone they may fall over, strike their head and then die, we should do everything possible to enlighten that person.

‘Changes in the law since the earlier guideline cases mean that crimes which result in death are now dealt with more seriously than before.

‘These are difficult cases to sentence, especially when several people are involved and the judge has to determine the weight which should be placed on one person’s involvement over another’s.

‘But there has been a disproportionate disparity between the sentencing ranges for murder and single-punch manslaughter. I also welcome the sentence increases.

‘I’m grateful that the Court of Appeal has been able to give us greater guidance as to how to deal with these particularly delicate cases which cause such pain.’

Murder of a family man

Ron Sharples, a ‘total family man’ went out to look for his dog after it was scared into running away by New Year’s Eve fireworks.

On a nearby street in Redcar the 52-year-old engineer met drunken teenagers Declan Appleby and Scott Fullam.

Fullam punched Mr Sharples in the stomach and he fell into a garden. As he got up he was kicked in the neck by Appleby and punched again by Fullam.

Mr Sharples fell, hit his head on the pavement and suffered a fractured skull and major brain damage. He died at 3am on New Year’s Day 2008.

Appleby, 18, was convicted of murder and given a nine-year minimum term. The trial judge later reduced this to six on the grounds that Mr Sharples had behaved aggressively.

But Lord Judge said yesterday there was never any suggestion that Mr Sharples provoked the attack, while Appleby had a serious record of violence. He restored the nine-year term.

Artur, the point is, you have an opportunity to put forward a discussion in which reasons are advanced for or against some proposition or proposal. All you have to do is attempt to make a valid point one way or the other.

It's a bit like claiming that a taxi is a real business or a taxi owner a real businessman. Now I believe that to be completely absurd, and the evidence, in this case, supports my position.

You, on the other hand, might disagree so this would be your chance to advance your case, while giving us all a good laugh in the process. :lol: :lol: :lol: :lol: A bit like what Kaiser did before he spat the dummy out over me making the claim, he was a pretendy businessman.:lol: :lol: :lol:

I'm guessing its a pretendy business now you're no longer involved?
Which taxi drivers deem themselves a businessman? I think you keep repeating that just to annoy.
Despite you and Jazzy b's enormous self importance don't you think this post is tasteless?

The problem is skull yourself and the jizz bar offer very little bar the same nonsense. But you're both too worried about trying to show off how intelligent you are without realising you're both fuds.
