Dear All,

As some of you will be aware our firm and specialist solicitors have long represented driver (both Hackney and Private Hire) across the country for many years.

The legislation as you will be aware is vast and cumbersome to say the very least. It is further complicated by each Council having its' own bylaws.

While many of you may have Union representation, we are finding a large majority who come through our doors do not.

We are now piloting a free legal advice line where all initial consultations will be free. We know of others (non lawyers) who charge for initial consultations. So feel free to direct your questions concerning suspension / revocation / Appeals to Sub Committee / Magistrates and Crown Courts to us.

We will be initially providing this service on a Wednesday between 11am - 12 to allow us to gauge the popularity of it. We will review in due course and adjust accordingly.

We look forward to hearing from you.

What if somebody needs advice outside those times, have they got to wait? If they emailed you surely you could provide advice quicker than once a week for an hour. Apart from that how many calls will you be able to answer in an hour?

We're very reasonable and flexible. If we receive calls in volume, we will simply increase the times and frequency.

You have to understand that we are also busy at Courts on a daily basis so we physically cannot sit on a phone all day. This is a free service.

Emails are of welcome. Please leave a contact number and someone will return to you within 24 hours.

For those who have nothing better than to leave such pointless comments, I would suggest that you simply don't read my posts. Simple.

Andy - As for the electronic cigerette issue - WOW. Without researching the issue my gut feeling tells me the following:

As we all know, smoking these things is not technically 'smoking' as they do not contain tobacco and are legal to use indoors. However, as I stated above it is open for individual councils to make their own bylaws (which it has resolved to do in this case) I feel if this was challenged, the Council concerned would have egg on its face..

The only other issue I see is a case for careless driving. It has long been accepted that even the act of selecting a cigerette from the box can cause a loss of concentation. However, if this was their thinking, it certainly does not highlight public safety in the letter...

Be very interesting to see the outcome on appeal to a Magistrates Court (or better still a Crown Court)

If they are going to suggest that using an electronic device is a distraction then how distracting must radios, dataheads, hailing customers etc be? :wink:

There's nowt for free, especially from the legal Eagles of the World who's talons are amongst the longest of all the birds of Prey, once a Bird of Prey has you in it's Talons that's it you'll possibly be bled to death.. :roll:

Logic stipulates that if they are safe to use in hospital beds and planes they are safe anywhere.
NHS Borders has said they are completely safe to use not only in there premises but anywhere in the world, even my own doctor is now looking into them as an alternative to patches and gum

I do believe that what we are talking about here is a policy on the part of the council not a byelaw. A byelaw, as I am sure you know, has to be approved by the Sec of State, and is a costly and time consuming affair.

Any chance to identify this case quoted by our Licencing officer?
