Tilting seats are more common on side loaders.
Any objections will likely be ramp angle or head room. Unless they've taken the bung from LTI and deemed rear loaders unsafe.
You might even find they'll licence it as a PH but not as a hack. Go figure. :roll:

If you are PH then the right of Appeal will be to Mags. but for Hackneys, the right of Appeal for the refusal to grant a vehicle licence application is direct to Crown Court. Councils can depart from their approved policy but only in exceptional circumstances. It is always worthwhile checking on a Council's scheme of delegation in order to ascertain at what level applications may be determined. For some, it may have been delegated down to Officers but for many, difficult decisions can only be made by the Council's elected Members sitting on a Licensing Committee.
The whole issue of WAV's is a tricky one as Councils have a legal duty to respect the needs of the community as a whole. While this will include members of the community who have to rely on wheelchairs for mobility you must also consider the needs of others with different disabilities such as hearing or sight impairment. ( the loop induction system in purpose built Hackneys for example) Key parts of the Equalities Act have yet to be enacted, in particular the section dealing with the ratio of WAV's to non-WAV's in a controlled district. We were expecting this to have been up and running by now but the DfT have not provided any guidance. The NPHA have figures that make interesting reading and the variation across the country is quite remarkable. For example, some LA's have a Hackney fleet on 100% for WAV's and others can be as low 20%.
Reference has been made to the ramp angle. You must remember that the ramp angle off a pavement will be considerably less than the ramp angle from the road. With rear loading, drivers are less likely to have ready access to a kerb.

This is a condition of license, not an initial application.

There are few "black" cab hacks here, yet next door (next LA) its 100% WAV hacks, though most are E7's and Vitos

Theres nothing at all in the regs about wheelchair access

ive asked, and asked what "purpose built" means (which vehicle)

they will have to have a meeting with solicitors about it

The E7 is a converted van. Allied Vehicles aka Cabs Direct import the standard van and convert the vehicle for use as PH or go even further and bring it up to full Hackney specification. The HC conversion has European Whole Vehicle Type Approval which further validates the conversion standard. Does this LA not have a published set of HC Conditions or at the very least a policy that you can access? Purpose built is a bit vague. You could argue that a Smart car is 'purpose built' to carry a passenger?
The message from the DfT is keep the specification for PHV's as simple as possible but LA's can put their own 'spin' on this and go for much more.

So is a Vito but they got approval by the PCO for London

anything +6 seats is almost certainly an ex-van, Tourneo, Traffic, VW Transporter, etc
