Personally I would say A, because being self-employed health and safety is your responsibility. He should have identified the risk via an assesment (the fumes if this was the cause of the illness) and taken steps to reduce the risk by either closing the windows, turning off the aircon or simply moving off the rank.

OR GETTING OUT OF HIS CAB WALKING A FEW PACES FORWARD AND TELLING THE ARSE WHIP TO TURN HIS MOTOR OFF.

Why did he not just go sit in the cab in front and enjoy his air conditioning?

Because round our way you rely on phone bookings and the driver would have been away from their radio as this driver works for "135 sweetie shop" cabs and they would never do so in a million years !

Not round our way it's still pen and paper for most you have to remember that most firms round here run with between 2 and a dozen cars with an average board rent of £50 running an office with staff and computers and PDA's is NOT an option

PS the name being used is a code just in case spaceshuttle one gets her nickers in a twist and throws a wobbly for criticising one of her drivers again

You could have said that earlier so that I didn't spend ages looking for them on Google! Most of the results were for Stamford USA!
