hi guys,
could anyone please help or give advise on an on going issue in our borough,our council created a rank in our local town centre,after years of trying for one,we finally got one,but it was created on private land,with the land owners consent,and after 3 months or so,the land owner decided he did not want the general hackney drivers to work from the rank,so he gave permits to a small taxi firm,this has stopped us all trying to work from the rank,the council want nothing to do with it,they say they cant enforce as it is on private land,but the rank still has council hackney stand plate on rank,we hae complained to the land owner and the council but they are both passing the buck,we belive once a rank by council it is councils responsability and what is happing is illegal,any info will be helpfull,

It sounds similar to taxi ranks at railway stations when the train operator or Network Rail can choose who they let on the rank. As it's private land, the council rank plates have no legal status under the Traffic Signs Regulations and General Directions.

The council have a duty to enforce all legal taxi ranks, be they on public or private land.

However they can't tell the land owner who he can and who he can't have on his land. In effect what you have in place seems legal to me.

I'm guessing you can't have a rank near on public land?

no we dont have a rank near by,we dont have a rank in the most thriving town in our borough,which is the one i am refering to,just to let you know it was our council that advised the land owner what to do about awarding a permit only rank

It would help if you could divulge what town you work in,
If a council licences you they are under an obligation to provide a rank, and not a private one

If there is a demand for one ie enough work to suport one, ask the council to provide one, there must be a popular place in the centre where most folk congragate
