I don't know if its any different in your district but in ours you pay your fee do the required tests and thats it you are given a blue book with all your rules and told too read it and off you go.i follow the rules and have been put in a position where I have to seek advice legally and friendly and now i hear of a union and blasted for not being in one but how else is one too find out about these things till they have to or realise they need too?

The council rules .if you was to read correctly i haven't threatened anyone or over charged thats the point to this whole thread and i did ask for advice not for sarcasm :roll:

I'd say that was an offence under section 55 of the TPCA 1847 - I'd also say the chap who started this thread was bordering on committing the same offence - if no offence was actually committed it would then possibly be a section 54 offence - refusal to drive.

We would all be very rich sitting on cab ranks cherry picking fares - because that's what it sounds like happened - the fact someone made a complaint at all is a minor miracle in itself.

No, It was outside Doncaster Racecourse. I was talking to some drivers when 3 chaps came out of the races, 2 of them were very drunk. They wanted to be taken to somewhere that was less than 1 mile up the road and the driver said he would take them for £15. They paid him and off they went. The other drivers seemed to be impressed that he had got the £15. I got the impression that this was the normal way that they work.

Back to the OP, go back to the council and tell them you'll be appealing against their decision to the magistrates court. It will cost you about £150-£200 to lodge the paperwork with the mags. You will be able to carry on working until the outcome of the mags court appeal which may not go your way. At least you'll be back on the road for a bit longer.

In the meantime, don't be tempted to have a go at other drivers for whatever reason. We're supposed to be professional and above "that sort of thing".

How can you overcharge someone when no money has changed hands?
