It's spent. It's not necessary to disclose it.

Because I have an old green paper licence, all my endorsements are still on there even though they are spent. LO copies it every year without comment, even though I don't detail on my renewal application. CRB comes back spotless.

I think this is out of order.

Until this year when things changed to the DBS, I thought that for taxi drivers there was no such thing as a spent conviction. All convictions had to be disclosed or you could lose, or be refused a license on the grounds of non disclosure.

I've not had any issues. I put on my licence renewal any new ones but not the spent ones. No mention at all on CRB/DBS.

One of our lot looks like she's having her badge revoked for not disclosing a SP30 to the Council this year.

When she went to renew her badge last week the Council noticed she'd hadn't disclosed a conviction from back in 2000, they've said they'll be going for a revocation.

Now she's not the brightest button in the box when it comes to rules and regulations but, I believe her when she says she didn't think she had to notify the Council when she got any conviction.

She's a cracking woman and would do anything to help you.

Sounds like our Council are making the rules up as they go along.

She don't have to declare it, its against article 8 of the human rights act?

Things such as speeding are not classed as criminal convictions so they would not show on a CRIMINAL records bureau check. I don't think any road traffic offences appear on the CRB.

Since 1999.

They have had CRBs since then, and the conviction would have been on there then and every subsequent check. It would be entirely reasonable for the driver to assume that has been taken into account.

The fact that the council haven't taken issue with it since, means they are either thick or they are now being mean. Possibly both.

Yes but not disclosing them,i know on our licensing it says all convictions must be put down including speeding. So not disclosing it could come back to haunt you.

How can you disclose something that hasn't been on your licence for 10 years?
