And this isn't just about the hacks, this is about the PH aswell, so yes I will show support for them aswell. The crime doesn't justify the punishment. So why don't you [edited by admin] off to benidorm with grandad

Hang about here, just because my view does not agree with your view, you decide to agree with an insult to me. I would ask you to apologize for the above comment.
It has been illegal for a few years now to smoke in a taxi and PH. All drivers know this but some choose to ignore it. Now it would seem that some are not getting the message in your area and so, quite rightly in my opinion, the LO is taking a tough stance. If drivers continue to break the law in your area I can see that your LO will have to get even tougher and this will eventually lead to someone loosing their badge permanently.

How long do you suggest then?
Assuming the LA actually has the power to suspend a licence?

How long do you suggest then?
Assuming the LA actually has the power to suspend a licence?

Actually for a first offense I would give a warning but for a second offense I would revoke the license.
I would also question the legality of a suspension.

If it is accepted that a council has the power to either warn a driver or revoke the license then drivers could end up losing their license permanently. So maybe a council will offer a suspension as a compromise between the 2 absolutes. The driver would have the option of accepting the suspension or if they don't want the suspension they would then have their license revoked and then take their chances on an appeal to the magistrates.

I don't think your right grandad.

Any council licenses a person based upon the persons fitness and propriety - to use a suspension for a week is more or less guessing that on Sunday night a person is unfit - but at the stroke of midnight is fit.

I remake the point - if this was a council employee who was caught smoking in a council vehicle - would they have been suspended without pay for one week or four - or perhaps just not at all because the fine suffices.

I think you missed my point. I don't think a council has the right to suspend a driver. However if they decide that sufficient warning has been given, then the only other action would be to revoke the license. I was suggesting that this council may be offering the suspension instead of revoking the license. I am not suggesting that this is legal or right but a driver may wish to choose this option instead of having his license revoked. I don't think a suspension should be compulsory.

The LA are not God Almighty.

They are bound by the law under which the licence is issued.
