It's not as if LAs abuse powers or act illegally without checking first that their targets are smokers #-o

Whether that's true or not, it's irrelevant. If parliament wanted LAs to dish out fines or suspensions, they'd have given them the power to do so.

Found this on st Helens council website , the link takes you to a document from a meeting where the licensing team changed the smoking legislation rules to an automatic ban for any hackney/private hire driver caught smoking on the job .There is no mention of the same punishment applying to council employees (refuse ,parks and gardens , meals on wheels and any other council driver).
