According to the Hackney Carriage Drivers - Laws and byelaws,
Byelaw 19 and 20, HC drivers must check their vehicle after each journey to ensure that passengers have not left property within the vehicle.

My daughter got a black and yellow hackney cab from Middlesbrough to Whale Hill on Sunday morning around 03.am (27/10/2013)
She had her mobile phone before she got into the taxi but didn’t have it when she returned home, she believes she dropped it in the taxi cab.
We have a security camera out side our property and when we checked it, it shows the taxi pull up to our property, my daughter pays the driver and then the driver turns round as if to turn the key and drive away, but just as my daughter steps out of the taxi, the driver looks round, then quickly turns fully around and looks at the rear floor of the taxi.
It looks like the driver has heard something fall on the floor and he turned round to look at it.
It is possible that he was looking that nothing had been left, but he definitely wasn’t looking at the back seat. The driver then drove off.
The driver was not white, a Large set man, with broad shoulders, with short hair and high forehead, he has a moustache and wide side burns that continue into a beard.
According to the Byelaws, the driver has 48 hours to hand in anything they find in their cab.
We will be contacting the police today, to see if anything has been handed in to the lost and found.
You can recognise the driver from the video and if the police locate this driver and it turns out that this driver saw my daughters phone fall and did not tell her, or hand it in, then it will reflect badly on all hackney cab drivers in Middlesbrough.

Did your daughter get his hackney carriage number or his drivers identification badge? She has the right to see this before any journey

If he's found it then like you said it should be handed into the Police or his office within 48 hours. Sadly there's to many drivers out there who will have picked it up and said nothing but, he looks like he's seen something when your daughter got out of the Taxi.

I'm gathering she had a security code on her phone and she has also notified her network about the loss?

Sadly they can only block phones that work within the UK, once they go outside of the UK the lock doesn't work anymore.

A mobile phone for use in another country which doesn't recognise the UK's blocked phone will command a decent months salary in our money. There's no doubt in my mind, that phone will be on it's way to the drivers homeland this morning bagging him a nice little earner.

Sounds like youve made your mind up allready ? Forget the bylaws if he found it and wants to hand it in your lucky,if not maybe he didnt see it and next punter in cab got it.Either way its not for you to decide hes stolen it.

On average i get about 10 to 15 calls a week "we have lost our" Mobile Phone/wallet/passport in your taxi on average we find the missing item on 2% of occasions people are always convinced or have been convinced by their friends that it must have been left in the taxi when in many cases they have been "borrowed" by "friends" or in most cases just put somewhere they can't find them of course people can almost never identify the vehicle/driver and in many cases insist on accusing the driver of stealing it !

The sad fact is that drinking leads to memory impairment and it is all too easy to make assumptions rather than try and methodically work out where the missing item is

cabbies do make a great effort to find and return missing property to it's owners unfortunately a lot of lost property is assumed to be left in a cab not actually so because people do not accept that they were as drunk as they really were !

I could be off of the mark on this one - is it legal to have a cam recording directly out onto the street? Your own property no doubt is a yes, out on the street I am not so sure. The reason that I say this is because if my thoughts are as mentioned, then the recording may very well be null and void in a legality sense.

Public area doesn't need any legal stuff IMO.

I am not trying to score over anyone - it is just in the back of my mind that the general public have to be very careful as to which way the cam points. In our fast approaching totalitarian state, that is a different matter.

For all anyone knows, he could be looking at the remains of a kebab or pizza your daughter left behind or a muddy footprint. :shock:

Your footage doesn't actually prove a thing, as i'm sure the cops will tell you when you report it.

Firstly, we are not all crooks.

Secondly, do as you said you would and report the loss to the police.

Thirdly, the responsibility to ensure the safety of the phone is your daughters, she is 100% responsible for the loss, no one else.
