hi
can anyone point me to the correct laws/bylaws that say taxi licensing fees have to be ring fenced

Both section 53 (drivers) and section 70 (vehicles) of the 1976 act allow councils to set fees for those licenses. Any money received must be used on the licensing function.

Any fee money that has been gained by those sections, yet not used for the purposes set out in those sections, is being unlawfully used.

Cant wait to hear from our LO where they advertised the £15 charge to plate using a "new keeper" V5 slip

it was retro-fitted....advised after it was imposed

You tell me....

its just says "from October 24th, only a 28 day plate will be issued for new vehicles using the "new keeper" portion of the V5, after 28 days if the full V5 in the new keepers name is not produced the plate will be void, a £15 fee is payable to upgrade the plate"


the letter arrived October 27th

So they can drop extra charges on us at any time for any amount for any reason they see fit?

If they have consulted on them, and the charge has been agreed at committee.

Not really sure what you are on about.

The sections say councils can charge for the taxi/PH licensing function, or words to that effect.

They don't say for the taxi/PH licensing function and any other thing they wish.

You must remember councils can only do what the law says they can, they can't do anything other than that.

In short you don't need to see the ringfencing word, as the law only allows money to be spent on the taxi/PH licensing function.
