Taxi driver who had sexual activity with woman with mental disorder disappears before jail sentencing

AN ALCESTER taxi driver facing jail for engaging in sexual activities with a woman with a mental disorder disappeared from his home before he was due in court yesterday (Monday).

Ernest Grainger, aged 62, of Alne Bank Road, Alcester, had previously pleaded guilty to indulging in two sexual acts in September 2012 with a young woman in her 20s whose free choice is impeded.

Known by his middle name John, Grainger was working as a taxi driver at the time and met the woman when he had picked her up as a fare.

Due to be given a lengthy jail sentence on Monday, he disappeared from his home in the middle of the night and failed to turn up to court.

However, police launched a search using officers, sniffer dogs, and the force helicopter. They found him in Worcestershire this morning (Tuesday).

On Monday Judge Alan Parker said: “I understand Mrs Grainger has attended to indicate he was at home last night, and was at home until something like five o’clock this morning.”

That was the time his wife heard him getting up, but did not think anything of it until she got up later to find he was not in the house.

Grainger had left, leaving behind his mobile phone and even his hearing aid. Judge Parker said: “It can’t be a case of him being delayed en-route.”

Noting that Grainger still had no-one to represent him, Judge Parker said: “A long custodial sentence remains inevitable, but the length of it is a matter for argument.

“If he had attended unrepresented I would not have dealt with him, but would have remanded him in custody and adjourned the case for representation to be obtained.”

Issuing the warrant for Grainger’s arrest, the Judge said: “It is obvious to me that in the last four or five hours he has sought to evade the jurisdiction of the court.

“It is to be hoped the warrant can be executed quickly and that he can be brought before the court.”

But Judge Parker stressed: “If he is brought before me at short notice I would not sentence him because it would mean he would be unrepresented and, of equal importance, it would prevent the victim and her family having the opportunity to attend.”

Therefore, he said, when Grainger is found, he intends to remand him in custody and adjourn the case to a later date to enable the victim and her relatives to attend the hearing if they wish to do so.

I wonder if he realised the implications of what he was getting into ?


The golden rule is never entertain any thoughts of getting involved with a passenger under any circumstances the consequences can be disastrous

The judge took the view that he wouldn't abscond whilst reports where being complied.

If he has attended every time he was bailed to appear, then the judge had no reason not to re-bail him.

And if the CPS took the view that the judge got it wrong they could have appealed the bail decision.

Taxi driver tried to commit suicide night before jail sentencing


AN ALCESTER taxi driver facing jail for engaging in sexual activity with a woman with a mental disorder tried to commit suicide the night before he was due to be sentenced.

Ernest Grainger, aged 62, of Alne Bank Road, Alcester, had previously pleaded guilty to indulging in two sexual acts in September 2012 with a woman whose free choice is impeded.

He knew that because of her condition she was likely to be unable to refuse, a court was told.

Known by his middle name John, Grainger was working as a taxi driver at the time and met the woman when he had picked her up as a fare.

He was due to appear in court on Monday but disappeared at 5am in the morning, leaving his wife at home. He also left behind his mobile phone and hearing aid.

Concerned for his safety, police launched a search for Grainger.

They found him in Worcestershire in the early hours of Tuesday morning, arrested him, and brought him before the court later that day.

When asked why he had failed to attend his sentencing on Monday, Grainger replied: “I was in a pretty bad mental state and didn’t know what I was doing. I was thinking of suicide.”

Asked if it was true he had made an attempt to take his own life, Grainger replied: “Yes.”

Judge Alan Parker said: “I have concluded you had it in mind not to come; that it was planned.”

He told Grainger he was not going to sentence him for the original offences until a hearing at the end of November to enable the victim and her relatives to attend the hearing if they wished to do so.

Judge Parker jailed him for 21 days for failing to attend court, and ordered that Grainger should then be remanded in custody until his sentencing.

Explaining his decision to refuse bail, the judge told Grainger: “I am satisfied that if I granted you bail you would be likely to fail to surrender; but a more overwhelming consideration is for your own safety.”

Judge Parker observed: “He is facing a sentence which, after a trial, could have been measured in double figures.

“On the other hand, it could be considerably less, subject to the argument on whether this was a breach of trust.”

Taxi driver jailed after taking sexual advantage of a vulnerable female passenger



AN Alcester taxi driver who engaged in ‘heavy petting’ with a vulnerable female passenger, has been jailed for six years.

Ernest Grainger, 62, of Alne Bank Road, was also ordered to register as a sex offender for life.

Grainger, whose life is now said to be in ruins, had pleaded guilty at Warwick Crown Court to two offences of causing or inciting a person with a mental disorder impeding her free choice to engage in sexual activity.

Prosecutor Andrew Wilkins told how the woman, who was described as ‘a vulnerable adult’ with a mental capacity in the bottom one per cent of the population, had been a passenger in Grainger’s taxi.

On one journey to a swimming baths, not understanding how he was viewing her behaviour, she had undone some of her clothing to show him her swimming costume.

“Mr Grainger treated that behaviour inappropriately, and on two occasions when she was his passenger he invited her back to his house.

“There they engaged in sexual activity. They had their clothes off and engaged in heavy petting, during which he penetrated her with his finger; and it is also clear that he gave her oral sex,” said Mr Wilkins.

When things the woman was saying about Grainger concerned one of her friends, officers looked at her phone, finding texts of an intimate nature – although Grainger had deleted them from his phone in case his wife found them.

Grainger’s victim told police she was frightened by the activity, and not really consenting to it.

On arrest, Grainger said he believed her mental age was that of a late teenager.

Mr Devine suggested: “From his point of view this was a lady who was obviously over the age of consent; and the question of her mental capacity and her obvious difficulties were not matters he considered.”

Jailing Grainger, Judge Sylvia de Bertodano told him he took advantage of the woman’s mental condition to engage in sexual activity with her.

She said: “She describes herself as being extremely frightened by what happened, and also having made it clear on at least one of those occasions that that was not what she wanted to do.

“You must have known she was highly vulnerable, and not at all in a position to consent to sexual activity with you. This is a very serious criminal offence.”
