If one TUPE case goes through no-one will bid on school runs for fear of having to take on the previous escorts and drivers, no wonder the council is taking advice!

The council have accepted that TUPE applies and the new company has agreed to take on the staff. I assume that they will be contacted shortly and any details will be sorted. :wink: I have told the staff to ask a few questions regarding employment such as the employers PAYE reference and their employers liability insurance also the vehicle maintenance records.

That's that sorted then. Does the new employer realise his obligations under TUPE, that his new employees have to be engaged on the same or better terms and conditions? I suspect he won't last long on that contract if he'd planned on paying other staff cash-in-hand!

Also, if as you say he's licenced in a different area to yours and your driver doesn't have a badge for that area, then it is the new employer's problem to sort out. If he then gets rid of the driver, it's unfair dismissal. KFC applies!

Existing providers will, and firms that are able to take the staff will also.

TUPE will stop the cheapskates trying it on.

He is licensed in our area. He is also licensed in Rutland. He currently has 3 vehicles that can be used on the job, all 8 passenger Transits. 2 are licensed as private hire in our borough and the other is licensed in Rutland.

They was an incident a year or so ago whereby a driver turned up to work in his own car with 4 new tyres on it. He went out all day in a company vehicle. When he got home at night his missus said "where are your new tyres?" They had only been taken off his car and put on one of the taxis whilst he was out driving. :lol: :lol: :lol:

Well the driver and escort have been to see the new company.
First thing he said was that their contract with me is not a contract and county hall have told him that it isn't and they will be self employed and paid cash in hand. When asked what hourly rate they would be on he told them that he didn't know because he doesn't know how long the job will take and they will get a fixed price for the job.
I contacted county hall and they are not best pleased because they have not seen the contract and would not pass a comment on it if they did see it. I told county hall that the staff would be paid illegally and that I considder them (county hall) to be complicit in this action.

Dear XXXXXX,
The 2 staff members had a meeting with XXXX XXXXXXX at XXXXX Taxis and he has point blank refused to employ them which means that he is not meeting the requirements of TUPE. Furthermore he has told them that they will be paid cash in hand every week which is illegal. He has also not told them how much that they will get paid for the job because he hasn't worked out how long the job will take.
Clearly under these circumstances the 2 members of staff will not be able to transfer.
Clearly XXXXX Taxis are not a reputable company and I will be reporting them for making illegal payments to workers. Unfortunatly because I have also made the County Council aware that the company are making illegal payments it will be neccesary to report that the County Council have awarded the contract even though they have been made aware of the illegality of the operation of the contract.
