I'd suggest it IS possible to have a s/e driver and employed escort on the same job.

The self-employed driver may be used on all sorts of other work during the day while the escort is solely or mainly used on the school contract and is employed by the operator to do just that. If the driver were solely or mainly EMPLOYED :wink: for that contract, then he would be subject to TUPE. There's nothing to stop the driver being self-employed the rest of the time.

We now make sure our drivers are employed for school contracts for this very reason.

The County Hall team told the guy that it was correct but he has been in the business for so long he knows everything and is never wrong. There were others around the table who can't believe that some drivers are solely EMPLOYED on school contracts and they do no other work at all. They didn't seem to understand that some people have retired but just want a part time job to keep themselves busy. We have 6 drivers that do this.

No but as you cant have 2 tax codes the PAYE job would taxed BR at 20%....

I have a standard tax code for my PAYE job and when I fill in my self assessment tax return I just put the details from my P60 on the form and everything is calculated and I then pay any tax that I owe.

You can elect to have your tax code split between 2 paye jobs if you wish. Just as it is against the law to pay to little tax, it is also against the law for HMRC to charge you too much tax. For the tax year 2014/15 if I have 2 part time jobs both paying £5,000 each then I can split my tax code and not pay any tax on either employment. Also because both jobs would be under the National Insurance threshold, I would not pay any NI at all.
