We have been getting busier by the month. We have some drivers who are self employed and some drivers who are employed by the company. The employed drivers only do the school runs where as the self employed drivers do school runs and any other work that they want to do. Previously when all we did was the school runs, the drivers were allowed to take the cars home to save them the time of coming in to get the car in the morning. However as time has gone by and we have had more drivers wanting to drive our cars in the daytime and the evenings/night it has been necessary to make better use of the available cars. In order for this to happen we made a decision that the cars that are driven by our employed staff just for the school runs would have to be collected from and returned to our base. This is so that we can make sure that the cars are clean and tidy for the other drivers. A simple and logical move we thought.
But oh no. One of the drivers is up in arms at the idea that he actually has to collect the car and return it. God is he giving me grief about it. He tries to engage me in "discussions" about it and writes to me every day with a "resume" of the previous days "discussions". Am I really asking to much to expect drivers to make their own way to work?
This chap is in his 70s and drives deliberately slow to get more hours in. I wish County Hall would give me notice on his job so that I could get him transferred under TUPE.

I suppose it down to how far the drop off or pick is from your office.

Buy him an old banger to run around in.

It is about 1 mile and he has his own car to get to work in. The school run that he does should take about 1 hr 30 mins to 1 hr 40 mins. We pay drivers for 1/4 hours so if the job takes 1 hr 31 mins we pay 1 hr 45 mins. However this driver manages, on a regular basis, to make the job last for 2 hrs and 2 mins by deliberately driving slow. Even the escort gets fed up with how slow he drives. Mind you I had to laugh this morning. He came round to tell me that at 55-60 MPH in 5th gear, the car is smoking a bit. Our tracker shows that at no time on the journey did he go over 45 MPH and the escort told me that the car never gets into 5th gear.

If a driver as 24hr access to a company vehicle it becomes part of his taxable income so just explain that to him and I'm sure he'll be glad to leave at your premises

If he's in his 70's you should give him a week's notice. TUPE and redundancy don't count (or didn't used to) for the over 65's, the retirement age. He would appear to be incapable of doing the job properly. It could always be that "they won't insure drivers over 70" :doubt: .

Edit to add

However, a google search revealed this: http://www.telegraph.co.uk/finance/jobs ... at-65.html

About 3/4 of the way down the article is a bit about doing a performance assessment on the over-65s. If his driving falls below what you could reasonably expect, then it's bye-bye! A for taking too long, tell him you'll pay him what you pay the others, 1 3/4 hors. If it's delayed through hi fault, tough tittys.

that only works if the job carries on, if it just ends surely TUPE wont be of use

Of course. The job is carrying on until the end of the summer term. I could always give notice myself and then not tender for the contact.

Then you will have to sack the driver

What defines the job as "not the same", different pickup (they move) extra kids, different dropoff?

My wife decided to drive the run with this driver escorting today. Now my wife is not known for driving fast, in fact I would say that she is a slow driver. The are some long term roadworks on the route which means that the shortest route is closed. The driver knows this, I know this and i thought that my wife knew this as well. Apparently not. Anyway, 1 of the students did not go today so this morning when the job was done by this driver it took 1 hr 24 minutes. My wife drove straight into the road closure, the escort (usual driver) said nothing. The total time for this unexpected diversion (cock up) was 18 minutes to get back to the original point where she made the mistake. So how long did the job take including this 18 minutes diversion................................1 hr 23 minutes. According to the tracker, at no time did my wife exceed any speed limits.
I think someone is taking my pants down and giving me a severe shagging!

Go to the Licensing, the school, the police and the press, tell them you have a taxi driver who drives too slow, tell them your main grievance is that he drives too slow on a school contract.

I think after doing so your problem will be solved.

What, at that sort of age? there's hope for me yet!!

But like I said earlier, a driving assesment should prove fruitful. If hi driving isn't up to standard, then he has to go.

Take him to one side and say, "you know how much I think about you and I'd hate you to get hurt but, I think someone is having a go on your wife while you are doing the school run."

He gets his foot down and does it in record time trying to catch her at it. Happy days, problem solved. :D :D :D
