Rhyl man jailed after making sexual advances towards taxi driverA BURLY Rhyl man who under the influence of alcohol and cocaine made sexual advances towards a gay taxi driver has been jailed for eight months.
Defendant John Dyson Hutchinson, aged 39, was branded by a bully by a judge at Mold Crown Court.
Hutchinson of Laurel Court in Rhyl, denied a charge of sexual touching but he was convicted by the jury.
Judge Niclas Parry said that the incident – in the early hours of Christmas Day, 2012 – involved repeated and prolonged behaviour towards a vulnerable victim who was providing a valuable service to the public.
The judge said that the defendant was seriously under the influence of alcohol and class “A” drugs.
“He was vulnerable, alone, gay and you decided to have some sport with him,” the judge said.
The victim was serving the public at an hour and on a day that many others would not want to do so.
The court heard how the taxi driver picked up three fares, the defendant, another man and a woman.
When the defendant was left alone in the taxi, he contacted two women who rebuffed him.
Prosecuting barrister Mr Gareth Roberts said that the defendant then turned his attention to the taxi driver, initially by making lewd gestures and suggestions.
It culminated with him grabbing at the driver’s crotch area.
One of his fingers went between the buttons on his jeans fly and touched him intimately over his underpants.
The driver was frightened and intimidated, and made an emergency call for help.
Hutchinson denied that any such thing happened and accused the taxi driver of coming on to him, and of touching and commenting on his large biceps.
An expert suggested that the defendant’s DNA found on the victim’s crotch area could have got there by “secondary transfer”.
Simon Mintz, defending, said the driver had ample opportunity to leave or to drive off.
But the driver told how he was frightened and scared and did not know what to do.
He alleged that after grabbing at him the defendant told him how he would put him over the bonnet of the car.
