Taxi driver jailed for reversing minibus into a woman's car outside Kendal's main post office



A TAXI driver has been sent to prison for a year and banned from driving for 18 months for deliberately reversing a minibus into a woman’s car after she parked in a turning bay outside Kendal’s main post office.

Carlisle Crown Court heard that 37-year-old Robert Atkinson was angry because Mrs Lee Bell was stopping him getting his minibus out of the car park after she dropped off her grown-up daughter behind the Stricklandgate Centre on July 23 last year.

He tried to do an “impatient” three-point turn, prosecutor Becky McGregor told the court, but when he failed he deliberately threw the minibus into reverse and rammed into the front of Mrs Bell’s car, causing £400 damage.

All the time, Ms McGregor said, Atkinson was shouting four-letter insults at Mrs Bell.

And afterwards, when she got out of her car to remonstrate with him, he blamed her for not moving her car by using foul and abusive language.

When she told him she was going to call the police, the court heard, he replied “I’d have no problem with punching you in the face” before driving off.

He was arrested soon afterwards at K Cars taxis, where he worked.

He admitted to the police that he had been “a little bit aggressive” but said he was just “agitated” because he wanted to get the minibus out so he could do his job.

Ms McGregor said that Mr Neil Barry, who witnessed the incident, later told the police: “He was using every swear word in the book.”

The court heard that Mrs Berry was so upset by what happened that she had to give up her job as a hotel manager.

She was now “fearful” and suffered panic attacks and was no longer as outgoing as she used to be, Ms McGregor said.

Atkinson - who used to live in Empson Road, Kendal, but has since moved to Ely in Cambridgeshire –pleaded guilty to a charge of dangerous driving.

In mitigation his barrister Chris Evans said the incident was the culmination of “two or three very difficult years”, which had included the collapse of his marriage.

“He had had a particularly stressful day,” he said.

He said he now accepted he had over-reacted “to a set of circumstances with which he should just have been patient”, he said.

Judge Paul Batty QC told Atkinson his behaviour had been “appalling and disgraceful”.

He said: “The courts simply will not tolerate this aggressive bullying of vulnerable women. It was quite outrageous conduct.”

There has to be more to this, as the penalty doesn't match the crime IMO.

I suspect much of this is down to a rather large claim. :roll: :roll:

Top judges halve Kendal taxi driver's sentence following 'road rage' incident



AN irate taxi driver who deliberately "rammed" a woman's car with his minibus during a road-rage incident has had his jail sentence halved by top judges.

K Car driver Robert Allan Atkinson, 38, was suffering from stress following the breakdown of his marriage when he "rammed into" the front of Lee Bell's car outside the main post office in Kendal and hit her with a volley of abuse.

Atkinson, who was enraged because Mrs Bell's parked vehicle was making it difficult for him to perform a three point turn, caused £400 worth of damage and left her "shaken and upset" when he deliberately reversed into her car on July 23 last year.

The cabbie, formerly of Empson Road, Kendal, and now of Lynn Road, Littleport, Cambs, was jailed for a year and banned from the road for 18 months in February, after pleading guilty to dangerous driving at Carlisle Crown Court.

Lady Justice Macur, Mr Justice Blake and Mr Justice Stuart-Smith, sitting at London's Criminal Appeal Court, cut his jail tem to six months and his driving ban to 12 months.

The court heard that Mrs Bell had dropped off her daughter at the Westmorland Shopping Centre in Kendal and was waiting for her in her car when Atkinson told her to move so he could turn his bus round.

When she was unable to do so because she was blocked in by the minibus and pedestrians, Atkinson lost his temper, purposely crashing into her car and abusing her before driving off after she said she was fetching the police.

He denied any wrong-doing when arrested but later admitted his crime when shown CCTV footage of the incident.

A previous hearing at Carlisle Crown Court heard that Atkinson had told police that he had been ‘a little bit aggressive’ and was ‘agitated’ because he wanted to get the mini-bus out of the car park so that he could do his job.

Lady Justice Macur today deplored the "road rage incident", saying that it deserved to have been met with an immediate custodial sentence.

However she halved the jail term after finding it was too long, given the nature of the incident.

She also reduced his driving ban in light of the effect it would have on his ability to earn a living as a taxi driver upon release from jail.

I don't think he will be a taxi driver any longer, unless the council are the stupid type

now that'll be the council in South Lakeland that allows their HC's to be used as PH in Manchester then :lol:
