Taxi Driver Online

At the taxi exhibition yesterday I was handed a leaflet from a company called Kapla.
the leaflet starts:-
Question: Are you ready for the new self-employment legislation?
Hint: Sorry to worry you, it's already here!
It states that legislation was introduced in the finance bill 2014 and became effective from April 2014.
The legislation means, if your drivers (and escorts) are under supervision, direction or control,you must now pay them under PAYE.
Does anyone have any other information on this?
I would have expected there to be a section on here dedicated to this change if it is correct.

I suspect it will all go down to the definition of 'control'.

Our council insist that any company doing school contracts pay the driver and escort, but how the companies circumnavigate around it is a mystery, due to them being self employed the rest of the day

That's not 100% right Skip, my Special needs contract brings with it a Council employee as an escort for the pupil, I don't employee anybody and nor would I ever want to for all the grief and red tape it brings.

It would appear to me that it puts paid to the cab barons and their "self-employed" drivers. If a punter books through "the firm", the contract is between the punter and "the firm". Anyone providing that service on behalf of "the firm", i.e. the cab driver, will have tax and class 1 NI deducted by "the firm" (the intermediary). It is "the intermediary's" problem to pay the tax and NI.

If the punter books the cab directly with the driver, then the driver is self-employed, no intermediary involved.

But then I may be wrong.

I think I have now worked it out,
If a person requiring a taxi, PH, and they call the office to book one, and the office calls upon a driver to go and do the run they are now employees, but if they are sole traders and they take the call personally the rule does not apply.
Have I interpreted it correctly or near as damn it

Yep, that's more or less how I interpret it. So, if you are s/e and your school is with XYZ Cabs, and XYZ Cabs gives you the school run to do, you are now seen to be employed by XYZ Cabs and they get lumbered with paying your tax and NI.

If you personally have the school contract with Midshire County council, then you are self-employed. If YOU sub it out to someone else, you have to pay his tax and NI. I think...

How do you interpret the situation regarding an office sending drivers for "normal" work like pick up from ASDA and take home?

Does this forum have moderators? I see a personal attack for no reason and its distracting from the original reason for the post.

If the office sends any driver hackney or PH regardless of if that driver owns there vehicle they are now employees, and it doesn't need to be an actual physical office, it could also apply to those that work car to car, I informed quite a few drivers of this new rule today and as usual most buried there heads in the sand
