But he isn't being fined, he is being charged extra for not working those hours. The firm could merely put everyone's dues up and offer a discount to those cars working those hours.

If he is a shareholder then I suspect there are other shareholders, clearly the others want it, or if they don't they know what to do.

As I said I think it's a sh** rule, but he has options other than leaving.

Indeed he does...............................he has my advice .........................which of course will be ignored ,,,,,,,,,,,,,,,he could make lods of dough out of this :D

Because greedy owners rip them off. We had one round here a few months ago where the owner tendered for a job and put a bid in for £15, he pays the driver £3.50.

And there's always some mug to do it for that price. However, if that's the price for driving, then so be it. Bus companies may tender £100s for a daily school run, but the driver only gets his hourly rate, but then he's EMPLOYED by the company.

Ive had a base who creamed the accounts AND paid 45 days from invoiced (invoiced last day of a month, so upto 75 days free credit when most councils pay 14 days from invoiced)

Just a thought, do the drivers who have their own kids to take to and from school have to work these hours (and in turn have to get a taxi for their kids!!) or are they exempt ? Could be seen that the company is discriminating against the part of the workforce that don't have children. If a rule is brought in it has to apply to everyone equally.

Have you thought about getting advice from Citizens Advice or maybe ACAS can tell you the legal situation about rotas and self-employment ?

Today a law came into effect giving all workers the right to apply for flexible working hours, a week after tangerines firm imposed set rotas :roll:

So the firm want to treat its (self-employed) drivers as employees but without giving them the rights that every other employee in the country is entitled to :x

they can APPLY but..........

the requests for time off are not granted automatically and may be refused on commercial grounds

I've just found this, what do you think ?

Unfree labour;
..which is defined by the International Labour Organization (ILO) as all involuntary work or service exacted under the menace of a penalty

Forced labour;
forced labour, also called Slave Labour, labour performed involuntarily and under duress

Forced Labour Convention, 1930 (No. 29) - [ratifications]
This fundamental convention prohibits all forms of forced or compulsory labour, which is defined as "all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily." Exceptions are provided for work required by compulsory military service, normal civic obligations, as a consequence of a conviction in a court of law (provided that the work or service in question is carried out under the supervision and control of a public authority and that the person carrying it out is not hired to or placed at the disposal of private individuals, companies or associations), in cases of emergency, and for minor communal services performed by the members of a community in the direct interest of the community. The convention also requires that the illegal extraction of forced or compulsory labour be punishable as a penal offence, and that ratifying states ensure that the relevant penalties imposed by law are adequate and strictly enforced.

Would forcing someone to do a fixed shift which they don't want to do and threatening to fine them if they dont fall under this ?
