The only court case that draws a parallel is concerning the Birmingham black
cab that was transporting a teenaged girl in her wheelchair, along with her
father as carer. The wheelchair was not anchored correctly, the cab driver
had to brake severely, the girl had brittle bone disease and the braking
action broke her neck and she died. The coroner said that the driver was
exonerated, because it was the father who had loaded his daughter in that
manner/position in the taxi, and it was the father who had supervised her
seat belt and chair anchorage, or lack of it.

Regarding pushchairs it will take a dreadful accident involving a
child in situ in its pushchair before anything 'formal' is done about this
practice. The outcome of such accident would be determined by whether or
not the driver actually placed the child/pushchair inside the taxi
him/herself (in which case he would be deemed to be responsible), or whether
the parent placed the child/pushchair together in the taxi and insisted that
they be carried this way.

In the meantime, I suggest placing a sign inside your taxis alerting
passengers to the effect that they must remove children from their
pushchairs and secure them properly in a seat with a seat belt. As:
"Warning: It is unsafe to carry children in pushchairs in the taxi. Please
remove your child from the pushchair before the taxi moves off."

But then you enter the realms of the latest child seat belt laws, as
documented from the Department for Transport. They
actually wrote "In cases where there is no child
restraint in [licensed] vehicles:- a child under 3 years may travel
unrestrained in the rear; and a child 3 years to 135cms in height must use
an adult belt and travel in the rear. Children up to 135cms in height may
only travel in the front seat of any vehicle if they use the correct child
seat/booster. Drivers remain responsible for making sure that passengers
under 14 years use seat belts/child seats/boosters as required."

So - it's clear as mud!!! - as obviously licensed drivers are not required
to carry booster seats. So if the child in the pushchair is 3 or under,
where do you put them? They cannot be carried in the parent's lap; they
must be separate. But "unrestrained"? This is such a grey area;

Agreed, but why bellyache afterwards?

Would they have got in a car if they thought the driver was [edited by admin]?

They should have declined the ride due to the price quoted, and stopped or not started the ride due to insufficient strapped in.

Instead they got in and continued the job when they knew the wheelchair was unsafe.

As I said the driver is and was a pillock, but so was the daughter.

sounds like the punters were well enough briefed by the licensing department tbh

What's the betting he did try to secure the chair but was told 'Don't bother I'll hang on to it'
Then had some falling out with the driver during the journey and decided to make trouble for him?

Was thinking the same myself,would estimate 70 % of cab drivers here don't strap/position wheelchairs properly,same goes for pushchair/nights.I don't really get the agreeing a fare upfront aswell ?

You're a cynical bunch :lol: Seriously tho, some passengers can be intimidated by drivers even when drivers don't mean to be, has anybody thought that this passenger was one of those. Some prefer to get things over with asap and then put pen to paper in the safety of their own home. What would have happened if the driver had decided that the best cause of action was for the passenger to get out and phone another company, perhaps the passenger didn't want to risk that. We all know how lazy some drivers can be ffs the majority can't even be bothered to attend meetings which involve them sitting on their asses and listening let alone taking the time to strap in a wheelchair safely :roll:
