Disabled man wins bus company case

Bus companies are not required by law to force parents with buggies to make way for wheelchair users in designated bays on vehicles, senior judges ruled.

First Bus appealed against a court ruling, won by a disabled man from West Yorkshire, that the firm's wheelchair policy was discriminatory.

Doug Paulley, 36, was denied access to a First bus to Leeds when a woman with a pushchair refused to move.

The court of Appeal overturned a judgement made at Leeds County Court.

'Request not require'

Mr Paulley attempted to board the bus in Wetherby to visit his parents in Leeds in February 2012.

But he was told to wait for another when the woman with the pushchair refused to move because her baby was asleep.

First's policy was one of "requesting but not requiring" non-disabled travellers, including those with babies and pushchairs, to vacate space needed by a wheelchair user.

A judge at Leeds County Court had said in September that was in breach of the Equality Act 2010.

Mr Paulley was awarded £5,500 damages.

Summary

There is no express provision dealing with the provision of car parking spaces under the Equality Act 2010.

There is some guidance provided by the BSI Standards on dimensions/the number of spaces and how they should be allocated. These should be considered and adhered to as best practice.

There is a need to make reasonable provision for disabled motorists in terms of the number of spaces, position, policing the spaces and monitoring the use of those spaces to consider whether changes are required.

IMHO, many wheelchair users mistakenly believe that The Equality Act is in fact The Priority Act!!

Ever been driven at by an electric wheelchair user at speed on a pavement?

I'm sure they are mumbling, 'I'm going to mow him down' as they drive at you.

It's not about the less well off.

It's about the attitude of some wheelchair users.

Not all wheelchair users, just some wheelchair users.

I'm sorry BC - but not being able to do anything because you physically cannot trumps everything - even attitude
