Caught speeding is a conviction, except taking the course option means no points on a licence

I am sure you will find that there is actually no conviction once the course is completed.



Why should I choose to attend this course rather than paying a fine and accepting points on my driving licence?
The idea behind speed awareness courses is the belief that if a person's behaviour can be changed, then this is more likely to prevent them from re-offending than paying a fine and receiving points on their licence. The Police do not record this offence as a conviction.

I absolutely agree.....there is no actual "Conviction". You also have to look at the PROPER hike in insurance premium if caught! It is NOT £200, it is in actual fact £100 from a given insurance company....again not written in stone so to speak, on that I would still challenge it as to how they arrived at that figure.

The insurance company look on it as a conviction, it might be recorded on the MIB database who knows but it's out there.

If its not a conviction per se, why do they send a "Notice of Intent to Prosecute"?


If I get caught with cannabis I can get a street caution, If i get in a fight I can get a caution, if im doing 36 in a 30 I get a £100 fine and 3 points on my licence for 4 years, it seems a tad weighted against us, im sure a warning for a first offence in (say) 5 years when within 5mph of a limit (or 10% whichever) would be more realistic

A police caution stays on your criminal record as though it were a conviction. I would NEVER accept a police caution and have had that on good authority. The police use the caution because they are too lazy/busy/don't have the manpower or sufficient evidence to take the matter to court.

The speed awareness courses are generally run by companies owned by ACPO Ltd., the Association of Chief Police Officers, worthy body of gentlemen who are out to line their investment portfolio and pension funds from such activities in the name of road safety. When ACPO "recommends" something to do with SACs or the threshold for not prosecuting speeding driver, this is taken as gospel by magistrates.

ACPO Ltd. has no more authority than McDonalds, the local golf club or Fred Bloggs Taxis Ltd. in influencing the law, but because of the name, it seems to have a magical authoritative air of respectability about it.

As an aside I was recently accused of dangerous driving whilst driving a vintage bus. I was invited to attend the police station which I politely declined and suggested that if the police wanted an interview, they would have to visit me or arrest me. the case was dropped due to lack of evidence.

Even a fixed penalty is not a conviction. If it were, it would have a date of conviction listed in the appropriate column on your licence. FPs only carry a date of offence.

Some insurers may require you to disclose a speed awareness course but it should say in their paperwork somewhere that they require this information. If not, then you don't have to tell them.

A 'conviction' is a verdict of the court. The police ca prosecute and offence but only a court can convict. Ergo, no court, no conviction.

If you plead guilty to anything you arent convicted then?....

If you accept a caution, you have, in effect, admitted guilt.

I have done two speed courses for the last two camera catches.

Will let you know if they show on there as well as the parking tickets for running out of time at work that were paid.
